Recorded delivery letter to 'the occupier'

Now this strange little letter is waiting for me at the post office. It is addressed to 'the occupier' and must be signed for. The guessing game is, what is it? I am quite frankly afraid to pick it up.

We found out our landlord is in receivership last month, so stopped paying our rent. They have no idea where our deposit is. The receivers are now threatening us with solicitors (but the five days is not up yet, so I don't think it is that). The flat is being sold at auction today, or Wednesday. We have given them notice that we will be leaving in three weeks. Do you think this could be a two week eviction notice? In which case would it override ours? I am wondering if it is some sort of court action?

I know the only way to really tell is to pick it up, but I am frightened!

    Yes, because I am either going to pick it up or not. It is an easy way of giving opinion is it not?

    Rather than have to type out the pros and cons etc. I just don't want to be caught in something horrible!

    Be a grown up and go and colelct if. If it is nothing to do with you, return it. S I M P L E

    The flat has been repossesed. It is being sold. Nothing can stop that. We have rather politely shown prospective buyers round.

    We have handed in our notice and we are leaving. So an eviction notice would seem rather pointless?

    I feel a general concensus of opinion here... thanks!

    PS Phoned Shelter originally and they gave us the advice that we are now following, i.e. getting out.

    Not picking the letter up won't change the contents or outcome. Personally I'd rather know what's in it than sit there worrying about what it might be.

    If the LL didn't have permission to let, they don't have to give you an eviction notice, the tenancy has no value and the repossessor has no obligation to serve any kind of notice. They may just be *informing* you that the balliffs are going in an claiming the property - it's in your intererst to know if this is going to happen as your stuff will be trapped inside. This happened to some friends of mine (the to the occupier letter didn't turn up) so they had half an hour (as the balliffs were feeling nice) to sticker their possessions so they weren't instantly disposed of, locks changed and a lot of hassle to reclaim their stuff.

    Thanks. I am also worried about this. It is a good job I know somebody with a spare room then! I had better start getting my boxes together. OH is going to pick it up today (which is the day of the auction- coincidence?). This is not a very nice situation to be in and very frustrating as it is through no fault of our own.
