    To be aware, if you own a freehold property then you may be liable to pay a yearly rentcharge or chief rent. You can confirm whether this is the case by looking at the deeds to your property. This legally remains the case even if you haven't been approached previously.

    However you can apply to the National Rentcharges Unit, which is part of the Department for Communities & Local Government, at [EMAIL="rentcharges@communities.gsi.gov.uk"]rentcharges@communities.gsi.gov.uk[/EMAIL] to pay a one off free to redeem it.
  • Can anybody please give me some advice?

    I live in a block of flats where Freehold Managers overcharge us for buildings insurance, in excess of £250 per flat per year. Is there anything that can be done about this rip off? I have my own buildings and contents cover policy for £120 per year which gives me a million pounds worth of cover. How can they possible charge £4000 to insure a block of 16 flats for a year?
  • they are not a nice bunch, I have 4 properties which they own the leasehold of, in the past 3 years they have tried to charge me for leeting the properties. The latest scam has been that they are chargeing me £200 per property per year for their permission to let plus £95 per change of tenant, and copies of all my tenancy agreements, (which would breach data protection laws).

    There is no provision for this within my lease, and I have in no uncertain terms told them that the £1000 a year they are demanding is unacceptable and not leagle they have since appologiesd but I am not happy so am sending them an invoice for the legal advise I had to get to rectifiy their demands.

    They are not nice peoplem and all their letters carry threats, I am not sure if they are the same company as they manangement company of the properties but judging by the manor with witch they work I would not be surprised if they were.

    I am very tempted to inform the LTV of their behaviour and see what they have to say about them

    If they try to charge you money for something make sure they have the right to under your lease. !!!!!
  • Hi - I have been asked to send a copy of my AST agreement in connection with retrospective consent to sublet. Is it true that this would be a breach of the Data Protection Act? If so, what should I tell the management company?

    No it is not a breach. A freeholder or their agent have the right to handle that information* and in turn are bound by the Act.

    *However you must check if you actually need consent. There have been examples here and elsewhere that the lease makes no such requirement, and letters have been issued by landlords or their agents solely on the basis that your postal address on their record is not the flat's.
    Stop! Think. Read the small print. Trust nothing and assume that it is your responsibility. That way it rarely goes wrong.

  • This nasty company cost us the sale of our flat. They dragged their feet about sending out correspondence to our cash buyers Solicitor and she dropped out of the sale.

    I agree they are not a nice bunch. In fact they are incompetent as well. A similar named company was registered in the Isle of Man but were struck off in 2009.
    Part of the Solitaire group which is now under the Banker's cosh!
    Their latest wheeze is evidently to try and claim ground rents for parking spaces allocated to flats.
    They also have come up with a scheme to suggest earlier rents were somehow in error and ask for more. No discussion, no calculation, just an invoice for the "backcharge" . Invoices adressed to "the current Lessee" or "The Occupier". All contary to the head Lease or Landlord and Tenant Act.
    Do they care? No! they would rather just send in threatening demands and cause distress to their Lessees!
    They are part of the Solitaire Group currently under the cosh to Icelandic Banks.
  • Yes, "rent backcharge" seems to be their latest trick; I've called them twice, asking to justify this new charge ; on both occasions the person said they would go and have a look at the lease details; after a couple of minutes I heard the handset being replaced.
    Very nasty people, on one hand I'd be happy if they take me to court, on the other hand what a waste of time with the whole process
