    I've just been in touch with my local RBS

    When I asked for a list of charges applied to my account they refused!

    They said any statement can be re-requested for £5 each!

    Is thei correct ? Am i not entitled to this info free?

    In regard to this topic, do you think I could seek compensation for being inconvenienced by a bank?

    Last year I opened a new current account and credit card account with 1st Direct. Unfortunately, the credit card was intercepted in the post and some very nice person ran up £2000 worth of debt in a few days.
    I was oblivious to this until I logged on to the website to see that the online banking facility was working.
    I promptly printed out the transactions and called the bank. They immediately stopped the card while I contacted the police. To cut the story short, the bank eventually refunded all the debt but did not give me any compensation. I did stress my point of being inconvenienced both financially and physically but they said the policy is not to give compensation.

    I promptly proceeded to close the accounts and vowed never to use them again.

    My financial inconvenience is not alot but I needed time off work to attend the police station and also to contact the bank. I also had to make numerous calls to the bank, police and the shops that the card was used in.

    The larger picture could have been identity theft but I am lucky that no credit has been fraudulently obtained in my name.

    This could have all been avoided if they did not issue credit cards that were already activated.

    Any opinions or reccommendations are greatly appreciated.

    Ive been with barclays since I started uni some 3/4 years ago.

    My overdraft and my credit card are over thier limits.

    Both are over the limit due to charges, charges I have alway thought were unfair.

    Can I still claim back these charges even though I am in debt to barclays? I wouldnt see any benefits from claiming them back, but im sure it would take atleast a 1/4 if not more off my debt, as most of my credit card debt is them charging me £20 for late payment, and then £20 again for the late payment taking me over the limit.

    That maybe true, but you can't automatically claim your court fees or solicitor's fees back from the Small Claims Court even if you win. It comes down to the court's discretion and it's rare.

    Just to clarify - if you were to win in the court - the costs would be awarded. It is very unlikely that you would get legal costs if you won in the SCC.

    I'm pretty sure I mentioned that in the article.

    Remember that these charges are ILLEGAL. What the banks are doing is tantamount to theft.

    Not really illegal - unlawful - yes. Illegal implies criminal - which could be argued in this case - although it is best to rely on the case law.
  • I'm sorry if I'm being a bit silly, but I can't seem to find the letter for writing to my bank asking how many charges they've made over the years (that's assuming they'll tell me!)- any ideas?
    I can find the letter for when you know the amount, but can't find the request.

  • Found it- it's in the library under "data protection act".
    Bit scared of asking for those bank statements- may get charged again! Will omit it from the letter...
    Still not sure who to post it to- am searching my bank's webpage...

    Ok just a couple of questions.

    I am currently over my overdraft of £1000 with HSBC by £150 and have just received a statement telling me that £75 charges will be issued to my account in the next week.

    I am currently claiming JSA and havent a chance in hell of paying it off, as it is all of my JSA is going on my overdraft is there anything i can do to stop these fees?

    I'm famous, my case is in the Daily Mail, thanks to a link to BankChargeShell from this site.

    I recently won £136.21 from the Alliance and Leicester and the Daily Mail asked if they could interview me for their paper.

    I'm sure this can only put more pressure on the banks to curb their excessive charges.
