Hi
I have been selling bits and pieces on ebay for nearly 3 years and have a good feedback score!
I dont offer a refund service BUT if a buyer were to contact me within 7 days of receiving an item they werent happy with I would ask them to return it and if it was damaged offer a refund(as I have done on a couple of occassions)
Anyhow this lady has contacted me today and said that a top she bought was faulty. She actually received the top weeks ago and left positvie feedback in the middle of Feb!!! She is demanding a FULL REFUND or else she will report me to ebay. I have explained that if she had contacted me within a week i would have given her this but in view of that fact that she left me positive feedback and that i havent heard anything until today I can only assume that maybe she has worn the top or washed it and damaged it herself!!
She has been very rude to me and I have said that that is my policy and that is that. She says she is going to take it up with ebay on Monday.
Did i do the right thing?
I love ebay and dont want to be struck off or anything.
The top was in Excellent condtion as described when it left here
thanks for any advice

Let her try it with ebay! She probably wont get anywhere! Why has she left you positive feedback and left it so long? Also why is she going to wait til monday to report it to ebay?Weight Loss - 102lb0

Hi
She has reported me to paypal!! She has filed a complaint and I have had to give my version of events!!So I will just have to wait and see. The top was in excellent condition when it left here- sold on the 5th Feb and she decides to wait til today to tell me!!! Said she has had it hanging in her wardrobe and only just noticed it!!!
Never been reported to paypal before so not sure how they will "go". Has anyone else had dealings like this with paypal?
Thanks xxxSealed pot challenge 7...my number is 2144.....started Nov 29th ....0 -

Well things are not finished yet she may have reported you but she hasnt got the money yet. I dont know how you described your item but if there is any difference then you can be pulled up for that. The good news is that that the buyer normally has to get an independant verification of the problem and fax this to ebay, with clothes i cant see how this is possible. Normally paypal find in the favour of the buyer, But the buyer is usually told to send the item back by recorded post (depending on weight can be quite expensive) and with paypal charging her £15 if she wins she could be out of pocket by some way. I dont know the value of the auction so can really comment further.
Worst case she get her money back and you get the item back but she has to prove the fault to ebay.
I would tell ebay you wont give her a refund as 7 days have past and you are a private seller and that the top was sold as described and unless you have stated new it should be then classed as second hand.
As the buyer is being under hand i suggest you be devious.
I had this problem when i sold a brand new electrical item a month later i was told it wasnt working and got reported to paypal. They of course won the claim as they obviously had a friend in the repair business who fraudulantly gave them a false repair report (i presume). Paypal asked them to return the item by recorded post which they wouldnt, they then tried a different approach and asked for 50% of their money back, i said no i wanted the machine back and they could have their money which incidentally paypal had seized. I had emailed the buyer several times using another of my email addresses which wasnt attached to any of my paypal or ebay acounts, i basically told them to carry on with the claim as i would get the item back which i could resell but they would get nothing as my paypal account was empty and i had cancelled all cards and direct debits associated with it. So all that would happen is paypal would likely charge her £15 for winning the case but she would get nothing as there was nothing i the account but she would still have to send the item back before any money would be released to her so she would be further out of case by postage and packing.
The moral to the story is dont accept paypal
see https://www.paypalsucks.com
She may not win as she still has to convince paypal she is due a refund.
How much is the item??? or what was the item number.
thanks"Save the cheerleader - Save the world"0 -
I forgot to say i won my paypal case as they buyer refused to send they item back so paypal closed the claim"Save the cheerleader - Save the world"0

Hi
thanks for that infor Zorber. So, I am correct in thinking she has to pay £15 for the "privelage" of paypal putting forward a claim on her behalf??
And, as a seller am I also charged the £15??????? OMG I hope not LOL
Laughing here if she is charged that(and I as the seller arent charged- fingers crossed) cos the top sold for £8.50 inc p and p
so she will be well and truly out of pocket even if she wins!!!
I have put my case forward and now it is going to be reviewed and I shall apparently hear in the next few weeks.
Thanks again- by the way your story made me laugh!!!

You wont get charged anything, she will get the money deducted out of returning money, so she obviously hasnt read the terms and conditions very well, she will also be told to return the item to you before releasing any left over money (does include p+p though) but in this case should be zero for her and she still should have to return the item to you at her cost.
I was you i would tell her this but not via an account that ebay can trace to you directly ie set up a new hotmail account. This might make the claim go away as such, as soon as she realise she will be out of pocket she should let it drop therefore the claim will naturally expire after 10 days. I wouldnt worry about it as i cant see it going forward. After the claim has expired you may have to ring ebay if they dont automatically release any funds they are holding, i had to do this to get my funds released promptly."Save the cheerleader - Save the world"0 -
Hi
They arent holding any funds at the moment as it is going to the "independent whatever" to make a decision. I think I will send her an email- I do have another account not linked to paypal/ebay!!!
She got very nasty but I just remained cool and to the point. Glad that she will be charged LOL
Thanks again for your help xxxSealed pot challenge 7...my number is 2144.....started Nov 29th ....0 -

Hi. Since when have paypal charged the buyer £15 for winning a chargeback? I only ask as Iv'e heard of people getting back every penny they spent and not losing £15. I know that if you do a claim through e-bay for fraud then they charge you £15 for the priviledge but I didn't know PP charged you too.
thx:heart2: Love isn't finding someone you can live with. It's finding someone you can't live without :heart2:0
