I understand that people are saying, oh you might as well try to get the deposit back from Virgin, but I honestly don't think it will do any good. I am sure it will say in the T&C that deposit is non refundable, so thats that. I hope I am wrong but I think that a game of "letter tennis" with Virgin would prove at fruitless and frustrating excercise.

I have been in the position of having to cancel a holiday for medical reasons about 4 weeks before we were due to travel, obviously we had paid our balance .We got 10% back from hol co as per their T&C , and that was that, no room for negotiation. (We then claimed the balance from our insurance).

I think most travel insurance will cover cancellation and so obviously it is beneficial to purchase as soon as you book the hol as its not gonna make any difference to the price you pay for the ins and will give u peace of mind. (I realise this last bit isn't gonna help OP now! Sorry!)

Good luck if you decide to pursue it.x
  • i have to cancel my hols as when i fell pregnant d.h. had to go part time to look after me and the kids due to a medical condition.
we took the insurance so would we get a refund, paid about £800 so far.

If you had to cancel due to a medical condition and not just because you couldnt afford it yes you wil be able to claim as long as you can get a doctors letter or he will be prepared to fill out the forms. Contact the insurance company and make sure you still have all the paper work for your holiday
If you look anything like your passport photo....Your too ill to travel

Try booking the holiday ONLINE again (obviously not going the whole hog of giving credit card details). - If holiday comes up as unavailable it would be reasonable to assume that they have re-sold YOUR holiday to someone else. They have not lost any money and morally they should reimburse you for most if not all of your deposit.

But you'll never know how much the holiday was sold for. Say the OP booked it at £3000, and Vigin have now sold it as a late deal for £2000, it's fair for Virgin to keep the OP's deposit to make up the lost revenue from the original booking.

I'd be surprised if you get anything back to be honest. Book the insurance when you book your holiday next time. I would just think of it as "lesson learned the expensive way"!
Here I go again on my own....

i agree it's far more complicated than that.

I know! But I also have experience of the other side of Virgin - last year we were stranded in Manchester for 28 hours because of a fault with a plane. They lied to us at the airport about when we were to takeoff and we lost a day and a half of our holiday and had we known about the delay (like Virgin did because the captain told us!) we could have saved more money by not booking a hotel at the airport the previous evening.
Do you think they offered any compensation to us about that and the fact we had paid for a 14 day holiday but only got 12 1/2? Of course not!
They did pay up though in the end after 6 letters and a summons issued for breach of contract in Small claims.
Virgin are not a small tinpot , one plane organisation, but they treat Manchester passengers like dirt compared to Gatwick!
I say go for the juggelar - nothing ventured nothing gained. The OP has nothing to lose.

Thanks I will... I at worst hope to come away with a few holiday vouchers to use when we are fit to go.

I will lose nothing but a few stamps trying.

Will let you know how I get on.
