    So can an elderly person who has to use a commode at night claim compensation if they have to empty it in the morning? Anyone know which government department we apply to?

    Nice one! And what about using a potty when a toddler? I think perhaps every parent who had to empty a potty must have a claim too?

    Hey I just wanna say that everyone makes errors - mostly they go unrecognised and unappreciated at the time - until after the event.

    The biggest error from the "non offenders" is pointing the finger from the ivory tower. This is very much a "self-aware" crime - the worst kind of all.

    I believe that it is not the ex prisoners fault that they are claiming, it is the government!!
    Right, I agree that if you didn't want to expereance this horrible chore then yes you shouldn't have done a crime to put you in prison BUT if the government are saying it was wrong for prisoners to do then WHY NOT get the compensation for it?
    I do think that anyone of you objecting to such claims would claim for money you were intitled too!
    The Human Rights Act is there for EVERYBODY and it wil not always work in the way people want as everyone has an opinion.
    And as for asking on a forum - you will find that every lawyer is different and it is worth knowing other peoples veiws of how lawyers deal with this claim!

    its all academic if the OP is in England and other half is...this has only come about because of a 'loophole' when the Scotland Act was taken in, the time bar was supposed to apply in Scotland and they are trying quickly to get it effected, needs Westminster to do it though so if anyone is to blame its them for dragging feet.

    Personally if i did the crime and did the time then i would have to take the conditions at the time. As i say its only the error or oversight made that has allowed the claims.

    not read enough- well the lesgislation - to know but off my head i think its been a oversight that has not given the scottish parliament the same safeguard of timebar. As can be seen from this thread the press are not good at stating the difference between English and Scottish law so most think what they read applies to both.

    I get paid £7 an hour and I empty commodes, empty catheters, wipe bottoms, etc. I think i'm due for a huge pay out!

    ok i thought i made the point in the first post that i didnt want a moral debate just advice please yes we are in scotland and we dont have an appointment with the lawyer until next week so i came on here for some pre advice to know what to expect

    Just out of curiosity, OP, what sort of compensation do you think is appropriate?

    i dont know, i dont even care if we get it or not i just thought seeing as he is entitled to it why not its fair enough saying if he didnt go to prison he wouldnt have had to do it but then theres all you people claiming back bank charges if you didnt go over your agreed limit you wouldnt have been charged yet its not legal and your entitled to the money back for it same as this
