Slopping Out Prisons?

I know alot of people have a problem with claiming this money as its for prisoners but my OH was in young offenders when he was younger and has since changed his ways and behaves before anyone gets on their high horse and he didnt rape or murder anyone as i can see a point in people getting upset about claiming for those type of prisoners, i just wanted to know whats the limits and rules around claiming? his lawyer said as its been over a year he cant but i read that the rules were changed and now they want to have them changed back? does anyone have any more information about this please

    I'm assuming that this would be a Human Rights claim, in which case your lawyer is right. Section 7(5)(a) of the Human Rights Act 1998 sets limitation at one year for claims. There is discretion under part (b) of that same section for the Court to allow a claim if it is equitable to do so, but there must be compelling reasons realistically why the claim has not been brought sooner.

    How long ago was this? Presumably your husband now wants to claim that being made to slop out was contrary to his human rights? Why does he want to bring this claim now? Why hasn't he brought it sooner?

    he doesnt i just read something in the paper about it being longer than a year hed given up on the idea he was only 17 at the time so didnt make a claim until after a year and his lawyer said it wasnt allowed after a year i just got the idea from the paper this morning as there was an arguement about wanting to change it back to a year since some legislation last year meaning it was allowed longer i dont really understand this stuff

    In Scotland or England? If Engand time bar is 1 year, it has never changed in England. Pity they never seem to report the differences between the 2 very different legal systems. The Legislation you refer to was the Scotland Act.

    Prison is punishment & I think its DISGUSTING that any claims like this can be made.
    My DH spent much of his teens & early 20s in DCs & prison & he agrees.

    I think he should take it on the chin and leave alone.

    If he hadn't done what he did he wouldn't have had to do it. Unlucky.
    Politicians and diapers have one thing in common. They should both be changed regularly, and for the same reason.

    Agreed as does my DH who has spent time in prison many years ago!

    Please tell me if I have the wrong end of the stick. Am I to believe the original poster is asking if compensation can be claimed for someone whom whilst inside had to clean toilets etc?

    If I am right then I agree wholeheartedly with Mrs E!!!

    If they are able to claim, it shows what is fundamentally wrong with this country doesn't it.

    Not exactly. Slopping occurred in prisons where basically there are no toilets and just a bucket in each cell, and 'slopping out' was the act of the emptying of those buckets by the prisoners en masse every morning. In the UK at least, slopping out has supposedly now been phased out, though there are reports suggesting that it still exists in some prisons.

    Thanks for clarifying that for me crazy jamie. I still think it is ludicrous they want compensation for this. From all that I see and hear they have too many 'nice' things in prison these days. If don't want to go to prison - it's simple - obey the law.!
