Red light !!!!

    Nooo, dont state your actual location! Just state that you werent in that location at that time and that you can produce CCTV and several witnesses to prove it!

    Don't understand that last point. To prove you were not in location A you have to produce evidence you were in location B at the same time (husband, other witnesses).

    You don't of course have to mention the traffic lights you actually did run through.

    If you are pulled up for the red-light incident (when they double check their records), you can argue you ran the lights in order to avoid an accident. Following car should show up on the camera. Since of course HE must have run through on red too.

    I'm not a do-gooder but have been nearly killed by deliberate red-light jumpers, either when driving or trying to cross the road, so my sympathy is limited.

    It would appear to be a clerical error - so you've still commited the offence.

    If you felt you were being intimidated, by a following vehicle, late at night & you crossed the lights in a manner which was safe to do so, in this sitution, not causing any other vehicles to brake/take avasive action, then POSSIBLY, you would be treated sympathetically, by a court.

    However, there is still a good chance, that you not only passed the red light, but were driving without due care & attention, as you failed to observe the stop signal & take notice.

    Be VERRRRRRY careful, of your response, to the NIP!!

    I haven't read all the responses but this is what I would do.

    Do not return the notice of intended prosecution. A summons will be issued to you in due course. Return the slip on the summons indicating you intend to plead not guilty and return it to the court. You will then get a date for a court hearing. Depending on the timing, you should be able to stretch matters past the six month anniversary of the offence at which time you should notify the prosecution that the summons is incorrect. They will then be too late to re-lay information at the court about the offence and there will be nothing they can do. If you tell them within the six month period, they will have time to do something about it.

    If you went though a red light, you were in the wrong.
    But they say you did it in a place you can can prove you were not at.
    I don't see how you can loose.
    I used to be indecisive but now I am not sure.

    You have to be careful with that.By not responding to the NIP you run the danger of being taken to court for failing to provide the driver information,not for running a red light. Your defence of not being where they said you were then goes out the window.

    But I do accept that you should try and stall things beyond the 6 month period.
  • as someone who's experienced a frightening incident of road rage, even if they find the right camera for you, if someone was really close behind you and the light was on orange, you must be able to say you went through because the other guy was so close and he would have gone into you, or reacted badly to being stopped? maybe i'm paranoid now, but i'll go through an orange light sooner than have a car that's been right on my tail stopped behind me for a minute or two...

  • you're also going to run the risk of them saying they couldn't have been that close if the camera could get your registration on the photo.
