Red light !!!!

Hi all

completely new to all this, but totally addicted, have spent sooo many hrs these last few days signing up to freebies and reading all your great info !!!!!!!

This is my first posting and a little shy, and not sure if this is the place for it but any help with my plight would be great.....

last week on going out to collect the OH from a late night session (as the good wife that i am) .... i was flashed whilst going through the lights , i thought i was on the amber, and there was someone very close behind so rather than end up with him in my boot i carried on.....then the flash went off, so not happy and totally blamed OH for making me go out and get him....

My question being that when i received my lovely letter today regarding this, they have put me down as driving in another town???? correct time, date but totally wrong location (about 60 miles away)....

can anyone advise where i stand with this??????

    No idea where you stand, re the incorrect location, but it does sound promising should you choose to fight it and they don't correct it before it goes to court. You could ask on sites like pepipoo for advice on that or in newsgroup alt.uk.legal

    On the amber bit you can ask for a picture and it will (should) show the stage of the lights.

    No doubt, you will get the usual do-gooders replying "you went through red you should pay and shutup" I am of the opinion that *if* you want to fight it on a technicality then all power to your elbow and good luck.

    write back to them and tell them that you weren't where they are suggesting you were at that time, so you're not prepared to pay. Don't tell them that you did get flashed. Don't offer any more info than you are asked for!

    Well I have to say that I go through amber rather than slam my brakes on and risk the car behind me going into me!

    I would have thought its maybe worth getting in touch with the Citizens Advice Bureau or the local police and see what they say. I would have thought that a technicality like that would get it thrown out!

    I didnt think you would be able to be done on going through on amber lights! Is that what it says? Whats its wording?

    I believe IMO that amber (along with red) means stop, at least that is what my brother was told by a traffic cop who stopped him and issued him with a ticket.

    BUT if the wrong location is given on your "letter", then tell them you werent there and IMO that should be the end of it.Obviously dont volunteer any other info
  • i think i am going to deny being at the location shown on the letter....
    yes maybe i should have stopped but then i would probably have ended up with whiplash after being rammed from behind, some boy racers thinking they were being clever.....
    maybe this is my little bit of luck for a change, and i am sure they make enough money from speed camera's etc, to miss my contribution !!!!

    Personally I would be inclined to opt for a court hearing , assuming you have received a Notice of Intended Prosecution and a request to provided details of who was driving at the time of the incident. It would give me a great deal of satisfaction to turn up and ask for the "evidence" of my offence and then argue that the location was incorrect and I was not there .Sometimes these things are computer generated and the quality of checking is limited. The old saying" Garbage in Garbage out" springs to mind . Good luck

    I would actually opt for not being in that location and being able to prove that you were elsewhere at that time should be no problem as there will no doubt be CCTV and witnesses to you being picking your other half up!

    And there was no way i could have got from the location they stated to where i picked them up in half an hr, so should fair ok.....

    Even so, I wouldn't state your actual location, as whoever reads it may compare it back to the camera location and spot their mistake.
