Would I be wrong to expect........

I bought a PS3 game for my lad and when it came the instruction booklet was missing.
I contacted the buyer twice asking where it was and why wasn't its absence mentioned in the listing as I wouldn't have bid if I'd have known.
Two messages and no reply so I open a paypal dispute, which got their attention.
They then inform me that I should have asked in the instructions were included and therefore it's my fault!
Now, I'm not best pleased and have escalated it to a claim but the real question is, was I wrong to expect the instructions in with the game and is it worth a neg'?

All their listing said was "USED BUT FROM A SMOKE FREE HOME."Terms & Conditions Apply0 -
If it was listed as "used", I personally wouldn't expect the user manuals etc to be sent as well. But you could probably get them off the site, as ArmitageShanks has pointed out

If they were available I would have downloaded them.Terms & Conditions Apply0 -
I would have expected the instruction manual.......
It is the sort if thing you read once and then slip back inside the DVD box.
It is part of the game package and sits inside the DVD box.....
If it wasn't there it shoud have been mentioned.
If you won a used CD you would expect the inlay cover to be there so why should this be any different :rolleyes:0 -
Not wrong to expect it but perhaps wrong to dispute over it if it wasn't mentioned...0

IMHO it's eBay, what you see is what you get. I'd never assume anything if it wasn't listed/in the picture.
Open a SNAD and let eBay decide - they usually favour the buyer.0 -

Seems odd that the buyer has to check if something is complete.Terms & Conditions Apply0 -
