    That is why I have not rung yet, as i think I will waste my money ringing them on the 0844 number, and get nowhere.

    Im waiting a few days to see if it gets any coverage on a bigger scale.

    You have to make a formal complaint 1st. I did that by phone, but there is an email option for contact.
    This starts the ball rolling & they MUST respond.
    I have had a letter confirming my complaint is being investigates internally & a follow up phone call from Scarboro so far, but will pursue it as far as necessary.
    Scarboro will sendyou details of the complaints proceedure, when you make a formal complaint.
    I have asked for an illustration, showing that i WILL NOT be out of pocket over this, whether i get it or not remains t be seen.

  • Letmeiniwannaaskaquestion, I did make it formal about 2 weeks ago..and as i expected, it is turning into a right faff,lol

    Got the latest letter from them not 10 mins ago, and this is it :-

    They are still reviewing my concerns, and as they mentioned before, referred it to the Scarboro legal dept. They then mention that i received a letter about my new payment (as i didn't pay that MARCH payment) and wish me to contact them if I am satisfied with it! Err, no, as it will cost me over £1000 extra over the remaining term

    This is the best bit... Should we not be able to resolve my concerns before the 27th March 2009 ( not likely, seeing as the letter was sent on the 25th, and its the 27th today) your complaint will be forwarded to the Skipton Complaints department, so they can review it :confused:Any one for a game of PING PONG?

    I also asked for a personal illustration for all this...I'm still waiting..I won't hold my breath

    Anyone else had any luck, or are they getting the same stock reply?

    MarkyMarkD may be correct in what he says but for them to get charged was just a bounus to me I've still got to follow any inaction from them with a letter to FOS.
    To me they have just increased a perfectly good fixed rate mortagage that I was paying to cover thier own changes to suit them without any acceptable timeline and with NO calculations for me to look over and only 11 days to pay a whole extra month out of one monthly wage packet. Utterly unacceptable conduct in IMO.

    What this is bascially going to come down to is whether Scarborough are allowed to do this according to the Terms & Conditions of the mortgage.

    If it's in the T&Cs - you're screwed, if not - they'll have to cover the financial loss.

    If you intend to complain then make sure you highlight any inconvenience this may have caused and also any resulting worry about your finances.

    Also, highlight any poor service - unanswered queries, phone calls etc. You may still get something for these even if the decision goes against you.

    Make sure you make them aware that if you're not happy with the result then you're going to take it to the FOS - this will cost them and they are more likely to pay an amount to avoid this.

    BUT DON'T make out you know that they will get charged as most financial institutions don't like to be held to ransom and will stand their ground as a matter of principle.

    Don't the T&C's have to be fair, a bit like what all the fiasco about bank charges that is ongoing is about.

  • Well I have heard back from the Scarboro, and in a nutshell..they say they can do it under the T&C's agreed by the FSA. The three options offered were the only ones on the table, and that I am very lucky as I can make overpayments and the svr is less with the Skipton.

    Alas, i have written back saying that the three options are unacceptable, and seeing as i fixed my mortgage for 10 years at £301, I expect to pay £301 and not £310 a month, and that i want to refer this the Ombudsman.

    As an aside, they failed to take the money out on the 01st and the 02nd..useless or what!
