  • I too have found my so called fixed rate mortage has gone up by £8.79 per month and I have 9 years left on a ten year fixed. I have made the phone call and got told it was legal basically, so I've now written the letter to complaints.
    Its laughable how they can get away with it with just 27 days notice of all this and just 11 days before I got to pay I get the figure, they ask me to pay 2 months payment out of one wage packet or increase my mortgage to compensate for them changing the way THEY work.
    I'm going to do my best to make sure this is as painful experiance for them as it is for me, so any advice on how I can make thier life hard and cost them money whilst they deal with me will be taken onboard.
    Actually any dvice at all on this would be gratfully apreciated.
    Afterall is not really fair, not clear and misleading from the beginning, and at the end of it all its costing me money.
    At least they have a free phone number for me to annoy them on.
  • Before the Financial Ombudsmen will look at it Col_1976, you will have to go through the complaints procedure with Scarboro, its a drag, but there you go..ring them up and make it official, then follow it up with a letter stating your reasons for being unhappy about it.

    My complaint is still being dealt with...it could take another 6 weeks..but stick with it mate!

  • cheers matey, already made the phone call and now sent the letter and I make my next move after the reply from them.
    I know it cost them money if it gets refered to the ombudsman so I'll do that if I don't get a satisfactory reply.
    I also think they have to send a letter with in so many working days (4) to say they are looking into my complaint as per FSA rules I've heard, once I've clarified that I will get on the phone to them if they don't stick to these rules.

    I'll keep you updated on my progress, would you be kind enough to let me know your progress if any.

    It doesn't work like that.

    You complain to Skipton. They reject your complaint and say it's a final response.

    You complain to the Ombudsman. They look at your complaint. If they think it's rubbish, they simply reject it. No charge to Skipton.

    If they think it's not 100% rubbish, they send it to Skipton. Skipton send them a copy of their final response which justifies their position. If the FOS believe Skipton's argument is overwhelming at this stage, they reject your complaint. Skipton don't get charged.

    Skipton only get charged if your complaint is good enough to get through these hurdles and actually get passed to an adjudicator and considered in detail.

    If 100 people complain to Skipton about this, only one complaint actually needs to get reviewed in detail. It will succeed or fail on its merits, and then the other cases will get dropped. If Skipton win, the FOS won't consider subsequent cases which are identical. If they lose, Skipton will be told to do something about it.

    MarkymarkD is correct in theory but those hurdles he's mentioned aren't quite as big as you may think. If the FOS feel there is any particular complaint point to answer they'll investigate it fully, especially if there is an allegation of financial loss. The building society/bank will get charged even if the complaint is found in their favour.

    There is a chance they could have a standard response if they get lot of the same type of complaints - it'll be investigated once and this will set a precedent.
  • This allegation is partly financial loss and mostly about the utter lack of information we have had in connection, I'm hoping not to have to go to the ombudsman but I think it will be inevitable as these kind of organisations try to wear you down with bureaucracy.
    MarkyMarkD may be correct in what he says but for them to get charged was just a bounus to me I've still got to follow any inaction from them with a letter to FOS.
    To me they have just increased a perfectly good fixed rate mortagage that I was paying to cover thier own changes to suit them without any acceptable timeline and with NO calculations for me to look over and only 11 days to pay a whole extra month out of one monthly wage packet. Utterly unacceptable conduct in IMO.
