Fraudulent debit card payment on my bank account

Hi,

I am absolutely fuming at the minute.

Wife woke up this morning - checks the online account same as she does every morning and chekcs it against our own spreadsheet to ensure every thing is in order. Nearly a £1000 down on what it should be.

Ring the bank (Abbey), to aks why. they say two debit card payments using her card from Admiral - one for £499, one £490. We protest, nothing to do with us, card details obviously been stoled - insurance etc - please cancel card, and cancel payments - rent has to go out etc. No.

What?

Can't stop the payment. We have to pay the £1000 before we can say we didn't spend it. They can't stop the transaction - it has to be paid. WHAT?

Apparently they believe us (yeah right) but they have too many people who order things and cancel payment to get them free etc.

After a long time on the phone this morning. got no further - there visa theft department can't help - has to be paid first? I don't understand. This is MY money, they are paying a fraud out with, refusing to stop payment. It's my rent money!!!! nothing they can do? passed all the secuirty checks - but won;t stop the payments going through???

How can this be?

I am resigned now to the fact i am going to lose £1000 initially. How quickly does this get paid back etc? I'm not sure about anyone else but I can't afford to start losing £1000.

The only help they offered was to extend my overdraft for me? What, so they can spend more of my money?

Absolutely fuming.

Where do I stand on this? If i get bank charges or charges from rent people for rent not being etc - who's responsible?

    Are they offering to extend your overdraft interest free? If they are then you won't be out of pocket financially at all.

    They are legally obliged to let the payment go through. The reason for this is obvious really, as if they allowed you to stop payments at your request, you could stop genuine transactions. This would then leave the retailer out of pocket.

    The way it will work with any bank is that the payment has to leave your account. You can then submit a fraud claim, and should get the money back in a few weeks. As it's a large amount, I would be very surprised if they could do the refund on the same day.

    It's also to do with prosecuting the perpetrators (if traced). If the money does not leave your account, no crime has been committed, so they let it go out, the crime is committed and then..... they catch the bad guys.:rotfl:

    You are quite fortunate that the money has been paid by debit card to a reputable UK company - should make it a lot easier to see who used the card. It could even be an admin or technical error somewhere.

    So what we're saying here is the law states - anyone is allowed to spend from my bank account whatever they please using my money and i am powerless to stop it and i have to try to claim it back which will take weeks.

    And that is your obvious point is it?

    And what about the fact i have banked with the same bank for 12 years without any hint of corruption or stopping payments or fraudulent activity. but because this happens i have to accept the fact that I have to pay for something i did not spend?

    If you know the answers ..... why post the questions?

    Everything you've been told is correct. The money has to go out to create an audit trail. They've offered an overdraft to buffer the shortfall. Normally you should not accept that until 48hrs after your card is cancelled. In this case it looks OK to do so as the money is not disappearing via ATMs etc.
    If you want to test the depth of the water .........don't use both feet !

    Where have i stated i know the answers?

    I was taking from other peoples answers and interpreting what they mean.

    Even though i know it to be a fraudulent claim, i am telling my bank - don;t let them do this. It's fraudulent etc - they can get the audit trail from Admiral - it was a manual debit entry which means someone has entered the details from over the phone - it's insurance - if it's car insurance - they have a vehicle registration - they have an address the insurance documents are going to - why do they need to take money from MY account for something I have not bought to create an audit trail? i have not sanctioned this purchase - i have not made this purchase - i am a loyal customer who has put a LOT of money through their bank in 12 years yet i am being told tough - they are taking £1000 of my money which hasn't left my account yet - so they can pay an insurance firm my money for something I have not bought.

    How does this sound correct to anyone except the insurance company or the bank which means their is only one loser - ME! why should i have an overdraft status on my account showing up on MY credit report for somethign I have not bought because of a law which seems to protect everyone except the person being hit by the fraud?

    And as for the overdraft - they did not offer me a free overdraft - they did not - they offered to extend my existing overdraft to cover my rent!!!! which i have to pay interest on?

    Forgive me if I sound irritated but it is because I am.

    people are talking to me like I should just accept the fact and what is MY problem with the way it works? That someone is spending £1000 of my money, and no-one gives a flying as long as the money men get paid - screw me and what it does to me. I understand the rule that people acan order goods - cancel payment blah blah - this is insurance - no goods are changing hands...it takes a simple call from Abbey to Admiral - two transactions for two seperate insuracle claims - my customer disputes it - says not ordered - can we check details - yep - customer is correct - cancel the order - no money out of my customers account - admiral - put a fraud investigation together with details you got - go get em if you can. Mr Saxton - your money is safe don't worry.

    PLEASE - someone tell me that the above does not make more sense than just letting someone get ripped off by a £1000 when there is ample opportunity to stop it?

    Rather than just saying what's yer problem? i know what's happenign is happening - i was looking for other options - not the simple live with it - tough sh*t attitude that seems to be given.

    A few months ago, my mum had some fraud on her account. The bank (RBS) refunded all the money within a week plus any interest/charges she paid by going overdrawn.

    my husband and i have also been defrauded of 583 pounds this week , found out today and have had to take a 600 pound overdraught to cover it to go out so that they can trace it , we are totally gutted , the thing that amazes me is that if i went to tesco with the debit card and tried to spend that amount they would laugh at me !!!!
    now we have to wait for the debits to go out then go to the branch and convince them of the fraud
