  • I've had my claim letter in with LloydsTSB since May 08... but never proceeded to instigate court proceeding due the 'ON HOLD' situation.

    Does my initial letter to the bank to reclaim my Bank Charges count as me raising a claim... or is the raising of the court order that officially counts as starting the claim???

    Any light, that can shone in this endless dark tunnel is much appreciated.

    Not sure exactly how far you have gone with the process. If you have got as far as requesting your money back and are in the position to start a claim with moneyclaim (irrespective that you haven't) then I think you are covered. However if you haven't got as far as that stage then I think you should continue.

    This said there are plenty of people on here who know much more than me!!

    The template letters on the website have been updated to include sections on what to put if you are in severe financial hardship. There is also a section on what the banks constitute as financial hardship on the website although to me it would seem that this is a given in this instance. Good Luck!

    A big up to Martin, the MSE Team, and to all those who sent-in claims.

    I'm just wondering whether or not the cost of paying-back the charges would be less than the legal bill the banks are now facing.

    Maybe the Banks should be forced by new legislation to run along the lines of those community-run 'local savings schemes' (I can't remember the proper name).

    Around a year and half ago I claimed some charges back from my bank but since then have incurred more charges. Can I claim these back too ??

    I'm in the same situation in fact.

  • I've read all the comments above, and I just need clarification of one aspect. My bank, the Halifax, says it has referred my account to a debt collection agency despite the fact that I submitted a claim for bank charges about 6 months ago. This should surely mean the account is under dispute, and if I understand correctly, that also means the bank cannot refer the account for debt collection while it continues to keep my claim on hold?

    They are also holding the claim even though I claimed under the financial hardship clauses. They also continue to hound us for money - we pay a little in, they then call again shortly afterwards hounding for more.

    Hi,

    Should I be re-calculating the interest on the claim that I have already put in with Lloyds TSB. Obviously with the case being on hold for nearly 2 years and most peoples cases being 6 years worth of charges, is this ok to do??
