Going Bankrupt & Voluntry Respossesion

    Quick update we went bankrupt on the 7th April, it was quite painless, our OR caled us the following day and said he would not need to see us for a face to face interview and would send our cases to the Leeds branch and if they need any more information they would call. We have now moved into our rented house and are stil waiting for Northern Rock to reposses the house from us but so far al we have had is 2 letters saying we are in arrears.

    For anyone concidering going bankrupt it really is not too bad i found so far the filling in of the forms the hardest part even though we did them on line.

    Counting the days to discharge now.

    Had call from the OR and our interview over the phone is on the 30th April hope it is ok.

    Good luck, not that you will need it. The phone interviews are fine just have a pad and pencil at hand,

    They will ask you questions about when you got the debts what you used the money for.. if you have sold anything in the past 2 years of value ect..
    I had a or interview over phone and it was fine.

    Hi, its been a while since I updated this thread.

    Our mortgage lender is taking us to court on the 25th next Tuesday for a hearing due to non payment of Mortgage, we have decided not to attend so that it will rule in northern rocks favor to reposses the house from us. Does anyone know how long we it will take before the house is repossesed as we still have a few items in the house that need to be taken out.

    The OR put my husband on a nil tax code but has not told us how to repay the money to them any advise on this one as we no longer have a cheque book.

    I have not been put on nil tax but i think that is because i informed them that i am now pregnant. They also asked us to sign a form to repay them between us £250 per month but this was based on the 3 month pay slips we sent them when we went bankrupt and a month after both our wages went back to basic no overtime, bonus etc we have told them why we have not signed the forms as we now believe we do not have this money spare and also need to buy for our baby. Anyone else had a similar situation?
  • Got letter from our OR and he is going to put me up for early dismissal think it must be due to being pregnant, will OH get early dismissal too once i have the baby?

    Still had no word from them about how to pay back his money he would have paid in tax, does anyone know how they will ask for this back as we no longer have a bank account with a cheque book.
  • There is no guarantee your OH will get early discharge, its one of those hit and miss things.
    Moon Beever should get in touch with regards to the tax, they will know you wont have a cheque book you should be ablet o pay via internet banking or S/O.
    Just keep the money to one side until they get in touch or contact your OR
  • I have just had a letter from the Tax office and they have now put me on a NT tax code and OH still has not been told how to pay meney back, this is 3 months now, i have wrote a letter to our OR but it seems to take them 3-4 weeks to respond!!
  • Just put the money that would have gone to the tax man to one side and wait for Moon Beever to contact you with details of how to pay them. Don't spend the money it is not yours.

    If you need immediate answers from the OR just ring the office, they are probably incredibly busy at the moment.

  • What would happen if the money we have put to one side had to be used in a emergency situation and then they contact us with the details of how to pay the money to them and we have not got it!!

    (THIS IS NOT THE CASE WE DO STILL HAVE THE MONEY PUT TO ONE SIDE)

    What would happen? What could they do to us?

    Has this happened to anyone before?
  • I am guessing They would apply for a attachment of earnings in order to recover the money
