Bailiffs and Council Tax, threatening me!

    The basics:

    I owe £1300 CT arrears (my bill in my name), bailiffs have been and are trying to kid me they need to come and sit down with me to fill in forms (dont worry, Im not stupid):D My partner is paying £20 per month on my behalf which is about all we can afford but they are insisting they want £115. I personally do not get any payment for unemployment or JSA as my partner earns an average £115 per week and this puts us over the £94 p/w that the government say we need to live on.

    I am now on the 3rd bailiff and have explained again that "" I am not in receipt of benefits or any other income "" "and please send the forms in the post"... to which he replied ""oh, ok..... i'll see you in court then Mr ******"":rotfl:
    Questions.

    Firstly, by paying a monthly amount even though its less than they demand can they still persue court action?

    secondly, If I myself get no money and its my bill (in my name) should my partner still be paying on my behalf?

    'and what is a probable outcome when I go to court?

    Just for information, I'm fairly clued up about bailiffs and the tricks they try and pull across the unknowing and ignorant. If they did come in and start itemising stuff .... theres nothing we (I) have that would even come close to making a dent in the money owing (no plasma tv, no games consoles, no mega hifi's) there are only our 4 year old computers and a 14 year old estate vehicle that could be of any value, but these are more 'tools' than play things. Would it be to my advantage if I 'relocated' the computers and the car and then let them in to play ball ?

    Just a thought :confused:

    Thanks Ras will go to the council today see what they can do then if they can not help (or will not help) will ask to speak to someone in authority at the council. I think the bailiff company rang me yesterday after they gave me the run around yet again and i told them if they could not rectify it will get the courts to decide and i explained to them i have evidence of what i have paid (receipts, letters from post office telling me what postal orders were cashed)

    As you have said here, you are contracted to pay certain debts. What must be remembered is that council tax is by far the most important debt as this is the ONLY ONE that could lead to somebody being sent to prison (very very rare)!!

    In addition, if you fell behind with payment to a mobile phone provider you would NOT get a bailiff at your home !!!

    Finally, as long as you REFUSE a bailiff entry into your home and you do not have a car on which the bailiff can levy, then he will EITHER have to return the debt so that you pay the council or otherwise accept your payment proposal.

    hi all
    Went council this morning they have agreed to fight my corner and help get my money back. They are contacting the bailiffs as council said they have not received there payment either yet. Someone from debt recovery will be ringing me later to let me know how things went.

    OMG !!!

    So there is ONE local authority who are willing to help...WELL DONE !!

    Please do keep us informed of the response from the council.

    Bit of a shocker really - very rare to get a council who actually accept their responsibility for their debt collector's actions.
