Bailiffs and Council Tax, threatening me!

Hi im new to this, and have read as much info as i can, i live on my own, have a fulltime job but had got into debt with numerous bills since my partner left me months ago.
I owe 1700 council tax and have been getting numerous letters from the bailiff, i made an agreement over the telephone just before christmas to pay 50 pound a month, i had no choice but to agree to this as they would not allow me to pay anything less, i missed a payment because i could not afford it and now they want the full amount or they will come with the police and take goods. I have just come off the phone to the bailiff and he says unless i pay 210 pound by wednesday then they will come with the police and auctioneers and take my property. The bailiffs have never come in my house, so unless i let them in i am led to believe that they cannont gain forceable entry to my property. i only rent the property as well. I am worried sick in what they can do. I have spoken to the council but they said they cannot do anything as it is with the bailiffs. The woman from the council said that if the bailiffs could not get the money or property in a certain period of time then they would send it back to them the council. The council woman said they then would more than likely reccommend a commital to prison.
Due to the bills i have my outgoings take up most of my money. I have downgraded as much as i can (bills, phone etc) but cant go any further due to being contracted to them.

I need some help Please...

    I dont know about this type of thing but what i do know is do not let them in your property at all!

    if they arrive with the police, the police will probably allow them entry because they have legal reason to be there. but im not 100%, someone else will know, good luck

    If the Bailiff has not been into your property then he can't force entry. Keep your windows and doors locked and your car if you have one parked away from your property as the Bailiff can levi on it. If the police were called it would only to ensure there's no breech of the peace and they certainly wouldn't help the Bailiffs to break in as they're not allowed to!

    I would also write to the bailiff company giving them a full break down of your ingoings and out goings - and then offer them something again, whatever you can afford. It might be worth posting your SOA if you haven't already done so then the folks on here might be able to give you more advice on where to make savings.
  • Is there anyone you could borrow the money from. Don't want to be doom and gloom and I'm no expert but Council Tax is one of those debts you really can't ignore. £50 does not seem much with a debt of £1700 so I think you were lucky for them to let it be that low. Unfortunately they do get really serious if you break an agreement and Council Tax should come before any other debts except mortgage/rent. If you can get hold of the £210 now they may let you make another agreement but you would have to stick to it. Try and work it out over the phone before they visit again as they will charge for every visit and you really want to avoid that. I doubt if they will bring the police unless you get funny but they still seem a law unto themselves.

    you need to pm Herbie21 asap. she has a website http://www.bailiffadviceonline.co.uk/ I understand that bailiffs are only brought into the situation once it has gone to court. Check this and if necessary call the bailiff advice online helpline number.

  • I don't want to be doom and gloom either but CT are a creditor who can and will make you bankrupt if you don't pay. CT is a priority debt.

    Can you borrow the money from family/friends? I know that's not an ideal situation but it might put them off for a while to give you time to get stuff sorted.

    In terms of prison, I know they used to do it years ago when Poll Tax was first introduced (cos I knew someone who did go to prison for non-payment many years ago), however, I'm sure they don't do that now as I think their preferred route is BR now.

    I cant borrow off family as they have nothing, im willing to pay the original 50 a month, but i could only do this by not paying other bills, but the bailiff wont entertain this, unless i come up with 210 by wednesday.
