Bailiffs and Council Tax, threatening me!
Comments
-
With the severe effects of the recession and the unavailability of cash borrowing it is the case that bailiffs are finding it extremely difficult to obtain money from debtors and they are having to go to extreme lengths to get debtors to pay. The threat of police attendance and committal proceedings is now commonplace....and debtors are falling for this time and again.
PLEASE do remember......The bailiff has no right whatsoever to request police to attend your home, and this is a THREAT ONLY.0 -
Hi I new here, but I was having trouble with the bailiffs and thanks to this site I had the confidence to deal with them
First I dropped my car off at my moms house then I told them I knew my rights, I told them thay couldnt charge for sending letters when trying to collect council tax, and that I was aware they could only charge for 2 visits no matter how often they came £24.50 for the first visiit and £18 for the second visit(not including levvying) I told them I knew I didnt have to let them in and I wasnt going to. When they threatened me with committel to prison, I reminded them over and over again I was not refusing to pay, I just couldnt afford the whole balance in one go, I then started making payments direct to the council via thier online system (it cant recognise that your account is with the bailiffs) the council told me not to do this, I told them I would keep doing it and no court was going to commit me to prison when I could show I was trying to pay, they just wouldnt take the money.
The council sent the payment to the bailiffs, and even though they had originally said they would only take full payment, they agreed to now take £10 a week, They said my case is no longer with the bailiff but with the bailiffs office so weekly payments would now be accepted.
thank you to all who have left info on the bailiffs, without you I would have surely had a breakdown and lost my car in the process, I was also in the process of stopping my house being repossessed, it has been a nightmare. I am now claiming benefits and if I had been doing this for the last 19 years I've been working, I wouldnt have had this problem. I have to get another job to save my home but I can see why some people dont bother. I really couldnt pay and these people and the council didnt care.0 -
I payout per month 580 rent, 117 car, 31 car insurance, 100 gas and electric as im repaying on that, broadband approx 24, sky 16.50, bt phone approx 14 month, 2 mobiles (1 which was my ex's but in my name (i know silly)) 68, house insurance approx 10, tv license 11 month approx (but paid quaterly), 60 petrol and whatever council tax will be once i start paying for this year. This totals 1031.50, my incomings are approx 900 wages, 40 pension, 180 tax credit, which total 1120.
I have lowered one mobile but cant the other yet, my sky is contracted for about another year and have that at the minimum 16.50, the car is on credit and is at the lowest they can go down to. I haven't put water down as im sorting that at moment so not sure what i will be paying. Need the petrol in car to get to work. Cant downgrade broadband as contracted.
This is all before i have paid for food for myself, oh and i have a dog as well.....
Its not looking good
Cancel SKY and Change you broadband provider. Do you even need SKY & Broadband... can cancel phoneline then too!
Are you claiming single person allowance on the CT? Are you paying less CT compared to when your partner was living with you?
Sorry to be harsh but you need to scrap luxury items and sort your debt out!0 -

I do get single person allowance, still 90+ a month when starts again, sky and broadband i could do without, but contracted to them, and the broadband is my lifeline of being able to be on here and get advice.
And im on here so i can sort out my debt!

Given the information you can get online that just isn't realistically available to ordinary people offline, special offers, lower web prices and ability to compare-shop online, better access to utilites and the council, I'm quite happy myself to see entry level broadband as important (maybe not essential) to everyone in the UK.
If something lets you look on places like this and shave 30% off the price of your weekly grocery shop, and reduce your bills due to things like paperless billing, I'd certainly argue it's not a luxury. If you don't stand for something, you'll fall for anything0 -
Thanks Robertmoir,
I have really knuckled down now and tried to save money anyway i can. Every few pence comes in handy.
I dont think its essential sky or broadband, but i dont want to fall behind with them and have more debt, once contracts are up with them i will then view my situation and decide if they are needed or if i can afford them.

I have had similar problems with the baliffs last week, I moved my van away from the house and woke up this morning and they found it and clamped it but the van was not in my name and he had to unclamp it, I phoned the poilice and they told me that they do not get involved, So when he threatens you with the police he is just trying to scare you. Told them that i am not paying and they can not gain entry into my house. I think it has now gone back to the council. Do not let them scare or threaten you. You need to contact cab and they will help you sort this out, even the police told me this morning that i have done the right thing contacting cab. The baliffs like us to think they have more power then we know but they have not. If you have a car get the log book changed over asap and they can not touch it, that is what i done.0

Just checked on line to see if the letters i had sent have been delivered and they had been.
I then recieved a text from the bailiff, this is what it said.
"Your offer to pay your council tax arrears is not acceptable. I have alrerady advised you that i will only accept an installment of 210.00 before considering arrangement on balance. Please ring me ASAP, to prevent further enforcement calls to remove your goods, which will incur you further costs. Yours Mr xxxxxxx."
Ok so i have now sent the letter that Herbie21 said and get this response. Where do i go from here. Council have had the same letter which i sent to the bailiffs. Do i wait on them.
Thanks

YOu need to tell him that you will not be letting him on the house to make a levy.
You have to keep your cool. First one blinks, loses.
Contact Herbie again.
take his name out of the post incase he checks here.
And see if you can chase ex. Presumably he is also liable for this CT debt?If you've have not made a mistake, you've made nothing0
