                    hiya,
some advise please:
i have sold a mobile phone on ebay,
it is brand new in the box and everything and has no problems at all, i did open it to have a look but im happy with my nokia n95 so i thought i would sell this phone,
i stated on ebay i had opened to have a look & i have not used it,
it is fully working and everything,
i also put on my ebay listing that i am not accepting returns for the item (i just wanted a genuine sale with no problems)
now the seller is saying the phone does not work and wants to return the item for a refund
where do i stand? i did state in my listing that i am not accepting a return,
there is nothing wrong with the phone.
advise please guys

            I quite expect you'll eventually have to accept return as stating "no returns" really means nothing. When you contact the buyer say you will be checking the serial number, IMEI number and the invisible security marking on phone and removable parts before refunding. Returns are at their expense and should be by a trackable method. (you don't have to tell them this as paypal will)I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

            If they can prove a fault with the phone from an independent source you may have no option but to refund if they went into dispute and returned by a trackable means.
 You may/would also get a negetive comment about you.
 I hope you kept info about the phone eg. imie number and serial number just incase they are trying it on.
 I am sure you will also get a few other comments from members to consider0

            Sorry but i'm not sure exactly where you stand with this but I would advise caution with whatever you decide as it is possible (and sadly quite likely) that the "buyer" could have already owned a broken n95 and bought yours deliberately so that they could swap them, send yours back and claim a refund- leaving them with the cash and your brand new phone.
 A similar thing happened to me, I won't go into details but basically I sent a sealed item, the buyer complained, I reluctantly agreed to have the item returned (very annoyed as my new and sealed item had now been opened) what I recieved back was a badly damaged box and a counterfeit copy of the item I had sent.
 Having bought my item from a well known store I knew it would not have contained a counterfeit and that the buyer had swapped their counterfeit item with my genuine one then tried to claim a refund!
 The way I dealt with it? Well it was returned without recorded delivery...
 I sought advice on here before dealing with it and that was among the suggestions given (very grateful to whomever that was!)
 Hopefully you will get some good answers here but in future be very very careful! One of the suggestions I was given (which wouldn't have been relevant to my situation but may help you next time or someone else who reads this) is to mark items secretly with a uv pen so if there is a return you can tell if it's geniunely your item. Though I'm not sure how well that would stand up to ebays "refund now, ask questions never" policy.
 Sadly sellers have very little rights on ebay.
 Sorry, I think I'm ranting now!

            I am assuming that the phone you sold is a new one, on contract, which you did not want. If so, and playing devils advocate here, then you could easily get it repaired/replaced by your service provider on the offchance that the buyer is genuine. Therefore your loss is the special delivery charge you paid when you sent it and your ebay fees.
 Establish with the buyer what is wrong with the phone and get a feel for the problem, their feedback, recent purchases etc. If necessary tell them to return the item, at their cost, and let them know that you will refund when you have established the serial number, imei number and have checked the security markings, (hint you may not have marked it but they don't have to be told this) Should it really be yours and definitely be broken then you will have to refund for phone, packaging and postage incurred when you sent it. If the buyer only sends it by normal post then there's a risk you never get it, but thats their problem not yours. If they send another phone then you could quite easily get the number stopped and they will have a paperweight only, let them know first and they might suddenly find they sent the wrong one back by "mistake"I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

            One mobile phone sold on EBay (brand new).............buyer claimed it didn't work, managed to replace it and hand deliver the replacement. Was not happy.
 Second brand new mobile I decide Amazon was a better bet. However they started a chargeback on that. Fortunately I had all the tracking details and never heard anymore from Amazon.
 Now i sell a lot and have been done on a few occasions however 100% attempts at fraud (albeit a small statistical sample) was enough for me. I don't bother with mobiles now.0

            I had the same sort of problem a few months back when I sold my new Sony E phone on Ebay, the buyer claimed it didn't work and wanted a refund. I contacted T-Mobile and asked about transfering the warrenty to the new owner so he could get it fixed, I was told as long as he has the original receipt for the phone then it is still under warrenty. I then photo copied the receipt and sent him the original by recorded post and left it up to him to get the phone fixed.
 I didn't hear from him again, but I still believe he was trying it on as I had checked the phone before I listed it.
 I would contact the people you got the phone from and see what they suggest
