Carphone Warehouse cocked up an iphone deal, can they renege the verbal contract?
To cut a long story short.
I have reached the end of my 18 month contract. I had problems with CPW about a year ago so to retain me the Customer Loyalty department offered me:
£5 a month - 600 minutes, 1000 texts (of course for such a low rental, there's no phone upgrade)
Me and the CPW rep were chatting away and he suggested that I could reduce my minutes by 200, and have unlimited web bolt-on instead. I could then buy the iphone PAYG, put my simcard in, and use this bolt-on to surf the net on the iphone.
I agreed, paid £342 for the iphone (this was yesterday), and received it today. Earlier on I called up CPW for another matter, and mentioned in passing about the deal I got.
They said the rep I was talking to yesterday made a mistake, and that the Unlimited Web Bolt-On does not apply for use on the iPhone.
Are they allowed to break the verbal contract? They said if I don't like it I can send the iphone back (no doubt at my expense, unless I feel like chasing them up for the next year).
What are my options here? Must they legally oblige by what the sold me or will they get away with it due to human error.
