Hi.
I am fairly new on the boards but have a lot of experience with Ist Credit as my ex had to file for Bankkruptcy and I was left in a lot of debt.
My dealings with 1st Credit were for an MBNA cc about 5k in total.
I went through all the right channels, SAR ,CCA etc. Disputed the debt as a lot of it was made up in late payment fees etc.
I did however make one huge mistake.
When I received the court forms I admitted the debt which I was advised to do by one of the debt charities.
This is the worst thing to do.
When I arrived at court for my charging order hearing I put all my evidence to the judge ,and managed to get the case ajourned for another month to try to fight my corner more effectively.
Sadly I saw another judge this time, and while he was sympathetic to my plight and listened to everything I said about 1st Credit breaching CCA regs etc, he told me I should never had admitted the debt as his hands were tied. He had to issue the Charging Order.
I was gutted.
Ist Credit are like a dog with a bone and just won't let go.Out of all the DCA they are the most aggressive and difficult to deal with .
Just don't sign any court papers that get sent to you.Dispute the debt all the way especially if the debt is partly made up of unlawful penalty charges.

I am sorry it did not go well for you I have read on here a few people saying they have went on the advice of the debt charaties and that it went wrong for them also. Can I ask how long from getting a CCJ did it take them to geting the charging order.February 2013 NSD - 40 -
Had a look at what they sent you cocker100. I agree it does look unenforceable. I requested one from LLoyds a while back and all they sent me was T&C when I replied that this was not what I had requested they told me there was no legislation that forced them to send me my CCA!!February 2013 NSD - 40

They went straight for the jugular and didn't bother with a CCJ.
From my first missed payment to Charging Order, it was less than a year:mad:
I had a DMP with CCCS at the time and was maintaining my payments every month.
They just didn't give a damn.
The people they employ are so nasty.
I spoke to one woman who suggested I 'get rid' of my dog and stop giving my kids school dinner money so I could pay more towards my debt !
I have debts still of about 68k, with over 25k being owed to Natwest, but 1st credit were the only DCA to secure a Charging Order.
Natwest tried but were declined luckily.

Thanks Hope1234. I am truly shocked I did not think any judge would grant a charging order without a CCJ. My understanding was that a CCJ was to be granted first and you only get a charging order if you defaulted on your CCJ.
Our debts in total are approx £39k with £10K owed to MBNA or now 1st credit.February 2013 NSD - 40 -
Good news on the Job LFTS!
If you've sent your CCA request then you are protected from any further action until they produce...........I am still waiting for mine since requesting in October ( after they sent me a Statutory Demand which I DID NOT acknowledge ) I have given them two further chances to get the CCA using straight forward letters.
However this time, after once again being told that 'it is with the OC (Citi ) and they will forward it when recieved from them' I have waited 8 weeks without contact from them ( as per the Compaints Procedure ) and now have sent a further CCA Request with £1 fee and informed the that they have 28 days to produce or it goes straight to the Financial Services Ombudsman.
They have ars*d about long enough, they've tried their best (or worst ) to get a Charging Order out of me, so the issue now needs to be forced.........prove it or p*** off.
Mr Hawker, the lovely Ms Shim-Quees assistant/replacment doesn't seem to know any more than she does and his letter writing skills are just appalling....
Keep your admin up to date with this lot LFTS and keep your Contact Diary up to date. Mine runs to three pages of A4! I always confirm sending a letter to them via an e-mail, just to get the auto-response in my mailbox.
Dont forget to Complain to the OFT....its free and anonymous but relies on the number of Complaints about a Co for them to actually take action, every little helps!:D stay wonky

This is some scary reading. if they get a charging order can they force a sale of your home?? What worries me is that that don't give damn how they get money and the judges don't seem to care either way. worrying

Which is precisely why it is so important to get a CCA request in on this bunch of vultures as soon as you can!
And to Complain to OFT as soon as tey breach ANY of the guidelines at www.oft.gov:D stay wonky
