Yikes 1st credit have one of our debts - Make that 2

I have read lots and lots about 1st credit and now one of our debts has been passed onto them. So I am starting this thread so I can keep track of where I am with them.

Debt is for OH MBNA card. So far we have not recevied a deed of assignment from MBNA or 1st Credit.

Last communication from MBNA was the 9th Jan advising a default will be recorded by 26/01/09 if x amount not paid.

First phone call received today from 1st Credit. OH advised he had not heard of 1st credit and very politley asked would it be better to wait for the letter 1st credit claim they have sent before entering into a conversation with them. They hung up very helpfull:rolleyes:

I am slightly worried about 1st credit. I am prepared to CCA them not to get out of paying this debt but to make sure that we can continue to pay it off at a rate that we can afford.

If anyone has any advice for me on how to keep one step ahead of them I would be gratefull.

Let the battle commence.

  • Yep, let the battle commence with them! I have a debt with them, I have fun with them on the phone now. I'm paying them via my CCCS dmp and they've even threatened to go to my mum's place and take her stuff to pay my debt. I owe them peanuts and my mum lives in the states so if they wish to pay for the flights out there to hassle my mum...let them do it I say!!!!

I live near them (for my sins!) and they are advertising for call centre staff at the moment...thinking of applying if I can get a car like the ones I've seen parked in their car park!

Anyway, Worst Crudit break every rule in the book - do not let them bully you. They say they will not accept monthly payments, they do eventually but it is a bit of a battle with them. They've been quiet with me now for quite a few months after months of harrassment from them I eventually spouted all the rules they were breaking and they put the phone down on me!

Am thinking of dropping a Valentines Card through their door later...haven't heard from them for a while and am missing their calls....!

  • Thanks for the replys.

If I lived closer I could have applied for one of their jobs but I think I am too nice a person to work there plus I do have some morals.

Well there letter arrived this morning. No deed of assignment though. I think next step should be to request one. Will email CCCS to let them now and see what advice they have.

I am waiting to hear if I have secured a job. If i have our income will increase and we could in theory pay this debt back in 2 and half years. Does anyone know if 1st credit would be open to this? I have read they will not accept a payment plan if it will take you over 7 years to repay.

  • Have emailed CCS asking for some advice on how to proceed with these people.

OH is at work this morning when he comes back we shall email 1st credit to let them know we are taking advise from CCCS. I am sure this will get their back up. We are also considering writing to MBNA for confirmation that this debt has indeed been asigned to 1st credit (I am sure it has however would be nice if these companys actually communicated this with their customers)

I spent last night reading everything I could on this site and others about 1st credit and it is absolutley shocking how they still have a credit licence.

  • Does anyone know where to find the ref number on 1st credits letters? Is it the number under the barcode?

    Thanks

  • CCCS have replied saying that 1st credit only need to send a letter advising they have taken over the account. I can not see how this can be correct but I suppose I must go on their advice, however i will still be sending of a CCA request this week.

Just off to email the nice people at 1st credit to let them know CCCS will be forwarding on payments from now on.

Have been looking at our budget and if the worst happens we can just about afford to repay it within 7 years but we would need to come off our DMP with CCCS so that we could make additional payments to 1st credit.

    Hi LFTS,

They are gits, but can be dealt with....just dont roll-over ( not that you would ). First thing is e-mail and tell them that ALL communication is required in LETTER form.

Keep an eye on how many breaches of the OFT Rules they manage by downloading same from www.oft.gov .

    Good Luck

  • Thanks Pepe. I was hoping you would pop on and give me some advise.

I am making a special little folder all for them and will print of the guidelines so I can mark them down as they are breached.

  • Hi there

We have also got 6K of MBNA CC debt now assigned to 1st credit so i shall be watching this with interest. I wont be talking to them I know that much, interesting to see how many rules they break as you say

  • OH has spoken to 1st credit today and wait for it. The guy he spook to was pretty decent (don't shoot me down) we were both very surprised. Of course they are threatning legal action and putting a charge on the house but we were expecting that. He did give us an option to stave off leagal action which unfortuntley looks unlikley for us however it was not as bad as I had been expecting, but in general was not a bad conversation.

OH wanted to phone them as he does not want to be seen as avoiding them. They are holding the account for a week for us to take time to re look at things so at least it means no calls for a week.
