argos, no item in box but didnt realise until we got home......

my wife picked up a 4gb nano from argoSW today, its for her friends daughter, she got it home and opened the box and there is no nano in the box or headphones, but all the paperwork and usb charger thing is in there, the box doesnt look tampered with (i'm currently at work so haven't seen it) she has phoned the store and they have said the manager is not in until this afternoon and to phone back, not sure where we stand on this, they are going to think that we have just took it out the box, i suppose it doesn't help that it was a couple of hours after it was bought that she noticed it, otherwise we are £179.00 down with just a ipod nano box.
I suppose we could always selll the box on ebay for £100 odd pound.
This kind of thing has never happend before, my wife doesnt want to go to the store on her own because she said there going to accuse her of stealing, but at the end of the day we have done nothing wrong.... sigh always happens to us!
The worst thing is she was doing her friend a favour by getting it because one of her children are ill and it looks as if were out of pocket now for helping out
This was yesterday and now it seems when I got home the seal on the box does look to be tampered with although my wife didnt notice when she collected it, i saw that it had been carefully lifted and stuck back down, well it looks like that because its not smooth there are some crinkles in it if you know what i mean...
my wife phoned the store only to be told the store manager is not in until saturday and that he/she can authorise this kind of thing, the whole episode is a nightmare, I'm annoyed my wife didnt checked but to be honest I wouldn't have done so either with argos, never ever had it happen before, perhaps if it was for me I would have checked the box in the car because I was excited.
No doubt we are going to be labelled theives on saturday in front of the store.

I remember reading on this boards after christmas that a few people had brought things from argos which didn't have the item inside the box. They took them back as soon as they realised and I think argos gave them a replacement.0

my local argos always opens the box and checks - maybe when you do return it you want to tell them this and tell them to do it infuture to stop this happening again - also, when you do buy anything again - open the box yourself and look.....hope you get it sorted - please post result...0

thanks for the replies, saturday seems such a long time to wait, especially since we have paid for a nano and currently have a empty box, most expensive box i've ever paid for..Listen to what people say, but watch what people what people do!!0

a friend of ours had the complete opposite of sorts. he got a digital camera from there and when he got it home it was missing the camera case so he went back to get one. they gave him a box with the case in. when he got home theyd given him another digital camera.
being the honest sort he flogged it to us for £70! (saving us £130) in the process.There's someone in my head, but it's not me0 -
does anyone know the law concerning items advertised in argos catalogue. seen a highchair in catalogue but scans at higher price ,and listed at higher price , do they have to honour the flash price next to the picture0

I think that the way they treat it is that the price printed is an 'invitation' to buy the product at that price. Many shops may honour prices in these circumstances as a matter of good will and customer service but are not bound to!

You cannot make a trader sell anything to you if they don’t want to. In civil law, when goods are displayed in a shop, a catalogue or an advertisement, this is called an ‘invitation to treat’. This means that it is an invitation for the consumer to make an offer to the shop to buy the goods, and it is up to the shop whether or not they want to accept that offer.
However the shop might have committed a criminal offence. This is because the Consumer Protection Act 1987 says that traders must not display misleading prices. You could report this to Trading Standards who may investigate the matter, however if this was a 'one-off' genuine mistake they would be unlikely to take any action.

Maybe the empty box is from one they have on display or something. Can't you go back in/ phone and get them to check again or ring the head office and complain, having to wait until Saturday is ridiculous. What if the manager was ill and didn't come back for another week? They must have a deputy who stands in in his absence.0
