    When I received the first solicitors letter, I set up a file and printed off every email relating/referring to the money. They are in date order and every communication by text is logged too to show his intimidating attitude towards me. I have the texts saved on my phone just in case the jodge asks to see them too. So I think I have that part covered.... fingers crossed.

    Basically, my defence is 1) there was no loan and 2) there are no grounds for a court case as once I said I wished to repay him, he set the guidlelines for repayment by saying - pay what you can afford, when you can afford. He also said pay your ther debts first then me, don't skint yourself (all in writing too). It is his guidelines I have been following and I have kept him in the loop all along.

    Do you think this will be a good enough defense?

    Thanks 3nicky1, you are right about the support on here. It has been outstanding and far more than I could have hoped for. Wish I had found this site before I let my ex husband rob me of everything I owned!!!

    Support from family and friends has been great too though. This weekend DS came home on leave and treated me and DD to an indian - it tasted fab! And just to top my weekend off, DD (who is only 11) has spent 2 hours pampering me with hair wash, back scrub and then she made a fruit salad - how wonderful is she!!

    At the end of the day, this is domestic issue and not commercial, it's going to come down on who the judge believes is correct, part of forming that opinion will be someone's character and honesty, it's for you to show what kind of character and honesty the claimant had.

    I'm not that good on techie information, but what I suggest you do is download the information from your phone and have it present in written formation for the judge to view, the judge won't have time to go through your phone, only if he want to see what's written in your statement ties in with the details on your phone.

    Go to theftechie forum on here, and ask the guys if it's possible to download the texts / messages you have stored on your phone.

    Court's rely on a paper trail, it makes the case easier to follow, make sure you have a paper trail from the start.

    The FULL defence needs to be submitted to the court 7 days PRIOR to the hearing.

    OP - have just read through the whole thread. You are amazing!

    One thought that crossed my mind is whether you could afford to make a second copy of all the documentation and stick it in a sealed envelope somewhere safe eg in a locked drawer at work, just incase.
