    So what section should I be completing as I dispute that this was a loan but I do want to pay him back?.
    I see the court papers are issued from Northampton.

    hey, just read your thread today - have no practical advice just wanted to offer support. It's tough being in debt as it is without bullying scum like this on your case. I think you've been so brave sharing it here and standing up to him. Keep your chin up, it sounds like you have loads of support and great advice from people here. x

    I don't need them, I just wanted to confirm you have them.

    What you need to do is register online with them and complete the acknowledgement.

    I have registered and chosen to defend all of the claim - time to face up to the bully.

    I had his message after choosing to defend:

    If you file an acknowledgment of service but do not file a defence within 28 day of the date of service of the claim form, or particulars of claim if served separately, judgment may be entered against you.
    If you do not file an application within 28 days of the date of service of the claim form, or particulars of claim if served separately, it will be assumed that you accept the court's jurisdiction and judgment may be entered against you.

    So I assume I now have 28 days to put my defence together.

    This was never a loan although he is now claiming it was, there is nothing to indicate it was a loan and all documents I have show my insistance at repaying him. He ignored the first few attempts but then he relented and said to repay what I could when I could (all in writing via email) etc... Someone has mentoned that the fact I set up a standing order could be viewed as a contract between us. Is this so?

    You have 28 days to file a defence.

    You do not at this stage need to go into to much detail, just give a brief statement of what your defence will be.

    At a later stage, you must file a FULL defence 7 days prior to a hearing.

    It's important for your defence you locate any documents which you'll be relying on in court.

    The claimant has to prove their claim, turn it on it's head, you need to prove no claim exists.
