evening ICAWSM sorry to see you've had a crap day. BUT....... just to reiterate what the others on here have said. You have the documerntary proof of how much he lent you AND all the pestering phone calls etc. Let it go to court. They cannot make you pay more than you can afford. It would be the small claims court anyway, not the crown court, so is way more informal.

Make sure you make that call first thing and let us know how you got on. Will be thinking of you today. Try and stay strong!! I moved 400 miles once we had been to court so that he can't find me - drastic times call for drastic measures but I haven't looked back. If court is the only way to go you have to face it and be strong or the fear will always win.I'm not a failure if I don't make it, I'm a success because I :tried!0

brilliant! I was sitting here thinking there has to be a way to prove how much the horrible foul nasty little creep lent you. the bank will have records.
Now its scary hon, I can understand that, even reading the letter I got the shivers, but thats how these things work scare with their officialness.
The court will not make you pay more than you can afford, they are looking for a fair judgement to both parties, you have never refused to pay and kept him fully informed of the payments etc. He on the other hand has harrassed you given mixed messages regarding repayments and now finally lied about the amount he has lent you. You have always offered to pay him. hang on to that.
Now get in touch with your solicitor and talk about what could happen next.
keep posting here and let us know how it goes. remember how far you have come you are doing great!!

I just wanted to add my support to what everybody else has already said.
I wonder how this guy could have convinced his solicitors that the amount of the loan was £5K rather than the £2K?
I think if it DOES go to court, he and his solicitors are going to look pretty silly.

Ok, I called the employee assistance line but they were not much help today. Her goal was to get me to talk to cccs which they have a fast link to so I would not have to wait for an appointment - my appointment is 3rd March.
She did advise me to write back and dispute the amount as I can prove it via my bank statement. I am a bit loathe to do that as I thought it would look better if, sorry whe I go to court. It could show his inconsistant approach towards everything???
Spoke to cccs and they have said the cc and overdraft I have with work should be classed as priority debts until my appointment - again this concerns me as she said to make token payments. I would rather pay in full where possible. I can pay in full for all but his gift/loan.
I did voice my concern regards a ccj - if I lose my job, I lose my staff mortgage (1%) and it reverts to a 7.9% variable rate. I would also be unable to remortgage anywhere else. Maybe the variable rate would be ok if I follow the cccs route.
I'm really confused now about what/where to go from here. There are 101 questions whirling roud my head but I can't focus one any particular ones. Feel like I am going mad. Fed up of crying and being sick, there is nothing let to bring up. I think I might need to go to the Doctors because not sure I am handling any of this very well now. I need perspective but am really struggling to get any.

have you spoken to your union rep etc to check the situation re the CCJ. As I said previously, if you do things throught he bank, you should be OK.
Secondly. If you are meeting the payments agreed by you (which you are) then you cannot get a CCJ. You can only get a CCJ if you fail to meet the deal that he had with you, which is that you pay it back when you can afford it.
So he is stuffed. Will not stop him trying, but with the evidence you have already shared, as long as you present that to court (or a friend presents it) he is stuffed.If you've have not made a mistake, you've made nothing0 -
Ok, after a particularly crap day yesterday I went to bed (having had a drink or 2 with a friend) and woke up in a better frame of mind. I am getting things into perspective now... no one has died and really, things could be a whole heap worse. It is a little debt that can be dealt with... by me. Time to get a grip! That little prat is getting stood up to.
Thank you RAS. Can I ask.... is it ok for me to be represented by a friend or solicitor in the County Court? I have saved all evidence for court and will write a time line log to back myself up. I will (if I can not be represented) as the judge to bear with me due to nerves etc and hopefully they will be understanding.
I am having problems getting through to the union at the minute due to bonus issues! Unfortunately the lower end bank staff who don't make decisions could possibly lose all of their £600 - £1000 bonus that they worked so hard for- Although the decision makers may lose some of their bonus, what they receive will still be over and above my salary for the year! Swines. But I will not give up trying to get through to them though.
