No problem then, you play by your rules, I'm giving my opinion on FACT in the cases I've assisted behind the scenes on here.
I'm not here to argue or score points with you, and for that reason, I'll not be responding to your posts any further within this thread.
Apart from saying, the onus is on each and every consumer to be 100% certain they fully understand any correspondance they receive from a creditor / DCA.
Look, let's clarify our positions. There's no need to sulk. We're posting on this thread for the benefit of the OPer.
I say that she shouldn't panic just because she has been issued with default notices; these are part of every bank's collections process as they are a prerequisite for legal action, if necessary, further down the line.
The OPer has already taken the correct action by making token payments, advising of fin diffs and submitting SOA to creditors.
I ask you again, for the benefit of the OPer - what should she do differently now that she has had a default notice? In fact, what should I, or any of us who get these things all the time, do differently? My Debt Free Diary I owe:
July 16 £19700 Nov 16 £18002
Aug 16 £19519 Dec 16 £17708
Sep 16 £18780 Jan 17 £17082
Oct 16 £178730 -
What's the thing to do if you get a default notice through then?
I didnt do anything with mine i hold my hand up and admit it mainly because i couldnt afford what they were asking for.
I then plucked up the courage to call the collection agency for my creditor and i spoke to the most helpful man in this world. he was lovely and he told me everything that is going to be happening over the next few months. they are passing my debt on in two months time and he told me the steps of this and that i would hear from the DCA and what to say to them
I now wish i had called them. he did ask for a payment at the beginning but when i explained i couldnt afford it and i was on a DMP the talking began. sometimes my debt panics me..... EVEN after 4 years or so.
I will be free in less than three years with a trust deed - my only option as debt management was taking too long0 -

i do agree with you here.
I should of called my creditor a lot sooner than i did as this could of all been sorted in december instead of burying my head in the sand. I am now a lot clearer what is happening to me and im glad i called them:mad: sometimes my debt panics me..... EVEN after 4 years or so.

I'm having a real down day today, been sending token payments to creditors since Dec along with letters (written by Payplan) explaining the situation and our income & expenditure.
I totally accept that we owe the money and we took the credit in the first place, I'm just fed up with all the letters either ignoring the fact that we have contacted them or admiting the got the letters but ingoring how much we have spare each month.
Just received 3 default notices, HSBC CC, Abbey CC and Egg CC telling me if i don't pay X amount by X date they MAY start court procedings.
Also thin I am about to be let down with my childcare so will have to either fork out for childcare (contacted tax credits and they can give £20 a month:eek: like that will even touch it). or leave my job which means we can't afford the mortgage.
Seriously wondering about going BR, our credit rating is f**ked so we weren't able to remortgage and we are also in negative eq by at least £20K!!!!
Not even really sure what to say, i'm just feeling so poo about everything
Hi MessyMum
I see a couple of issues here
One is that you're not getting as much support as you would like from the debt charities. You haven't posted a statement of affairs (SoA, calculator here) so it's difficult for us to give good advice. But I suspect your available income for your non-priority creditors is lower than the minima for Payplan and CCCS, which is why they've not taken you on.
So you should know that the CAB have no minimum amount, and you might want to contact your local bureau.
I am also a bit concerned about your mortgage. Are you in arrears and/or unable to meet the contractual monthly instalments?
Making token payments is a useful holding strategy. Whether bankruptcy would be a suitable longer-term strategy is impossible to say on the information we have so far but it's why I'd like to see you run your situation past a qualified debt adviser - again CAB and/or National Debtline.0 -
Thanks for your reply's everyone.
I will get the default notices scanned in and put them up.
I did a SOA a few weeks ago and got lots of helpful advice from peeps on here. Guess I should do a new one as we have changed insurance and a few other things so have a bit more cash to throw at debts.
At the mo we are up-to-date with the mortgage, its just the unsecurred debts we are not meeting.
I would love not to work and stay at home with my 15month old, but we can't afford the mortage & bills/food etc if i don't work. Don't think we will be able to sell the house without leaving a shortfall so its really not an option.
Again thanks for all your comments, I will get a new SOA done over the weekend.
You have all made me feel much better thanks0 -
oh forgot to say, didn't realise CAB didn't have a minimum excess, will give them a call next week x0
