Hi all im new to this but would like a little advice, after requesting my credit card statements my bank has told me they have no record of any cards i have held (both with them) i paid last one off in jan 08 (through a loan with them), and it shows via my bank statement, i found 1 credit card statement with details on which they have asked me to take in to them to try and trace the card details, where do i stand if they have no record at the bank, i would be grateful for any help thanks
Hi and welcome
If you only just settled an account in 2008 they they should at least hold some details on you, in fact they should hold your details going back as far as 5/6 years, even from earlier years.
However, if you request a SAR (Subject Access Request) with an enclosed payment of £10 postal order or cheque payment they MUST comply by 40 days, if they are not able to then they must return your payment with a letter of explanation.
So it maybe wise if you have not requested for your information this way, by sending a SAR letter, I think you will then end up with your info, if not then you can complain to the Information Commissioners Office (ICO) about them as its only 2 years ago you settled the account and they SHOULD still have these details.

A SAR template letter here:

Hope this helps, fingers crossed, please keep us posted, cheers.:)The one and only "Dizzy Di"0 -
Your welcome
In your case contact the Financial ombudsman service (FOS) and ask if they are able to check this out for you, if you explain your situation, they will look into this and also ask them to write to them for you, they will check who and write on your behalf if you request for this.;)
(they will get to know who is responsible)
http://www.financial-ombudsman.org.uk/contact/index.html
They may even tell you over the phone, don't think the FOS will be open until Monday now though, you could email them, but then you may be waiting for a while before they respond, as I am aware they have backlogs of emails to get through as well, so give them a call as soon as you are able to, good luck, please keep us posted.:)
Thanks again!
I've been doing some serious reading over at the CAG website and it seems that the most widely used tactic is to go for the the most up to date creditor, which is Barclaycard.
Barclaycard now own the whole Goldfish portfollio and the account defaulted after it was transfered hook, line and sinker to Goldfish removing Morgan Stanley from the equation. So the liability lies with Goldfish, who are now Barclaycard.
Also, if DCA went to Barclaycard for my CCA request, then they (Barclaycard) must have all the details of my account on file.
Phew!!! Complicated stuff!!!
I think i'll send the initial complaint to Barclaycard and see what they respond with. If I get nowhere and they fob me off, i'll use your advice and contact FOS to see if they can shed any light on the matter.
Thanks again for your advice, i'll keep you posted!

Hi all,
I'm after some advice again!;)
I'm in the process of reclaiming the ppi from yet another account of mine. This time it is from a defunct and defaulted old credit card that was originally taken out with Morgan Stanley Dean Witter in 2000. The Card was then sold to Goldfish and I defaulted shortly after that. Since then, the Goldfish portfollio has been sold on to Barclaycard. My account is now been bought by a DCA and is part of a DMP.
Now I know that you go after the original creditor for any ppi reclaim, but which one? Morgan Stanley applied the ppi to the account without even asking me, so in my eyes they are at fault. However, Goldfish bought them out and it was them who sold the debt to the DCA. Then there is the fact that Barclaycard took over all the old Morgan Stanley accounts after the account defaulted.
So who do I send the reclaim to? Morgan Stanley, Goldfish, or Barclaycard? MS who sold out to Goldfish. Goldfish who are now defunct but flogged the debt. Or Barclaycard who have never dealt with this account as it was sold to DCA before they bought the Goldfish portfollio?
Any ideas?

Hi Cocker, we had a similar problem with goldfish/taken over by barclaycard and al leicester/passed on to mbna. I wrote to the company who were running the account at present and got a refund from them. MBNA also suggested I contact Al & leicester as they had the original agreement so I'm in the process of doing that now.
Good Luck you are on the right track.:T0 -

di3004,
I have a hopefully easy question to answer. When sending a SAR to your bank who do you make the cheque payable to? I am certainly living up to the Newbie title with this one. Regards,
Paul0 -
