    what about asking MSE to start a petition at number 10 to get the goverment to force the FSA to act against the Banks and their delaying tactics, in particular the "state owned banks" i'm sure it would get a lot of support.
    and could make a difference to all those people who will be claiming in the future.

  • Hi everyone , hope someone can help me on this one , around ten years ago i took a loan out with hsbc bank, i was definately missold ppi at the time as i remember being told i would not be able to get the loan without it, the loan still had some outstanding on it and was still being paid in 2005, so didnt end more than 6 years ago , i no longer have the paperwork so sent a letter requesting a copy of it .
    I have just recieved a letter back saying the banks retention period is 6 years and therefore they are unable to supply the agreement .... is there anything i can do from here ? many thanks if anyone can help :beer:

    Hi Andy and Welcome.

    Did you request for your paperwork by requesting a SAR (Subject Access Request) here:

    With this you enclose £10 postal order or cheque payment and they have 40 days to comply.
    So basically just as long as you have an account number you can still continue to make a reclaim.

    In regards of agreements this can be a problem if this was settled/paid off over the last 5/6 years, but they should have details within a SAR to help you through this.

    just make your claim - you don't actually need any more information then your account number and the reason you believe you've been mis sold to
  • Hi there, up until today I was only an avid reader of this forum and did not post anything. Firstly I would like to thank all you guys and Martin for the fabulous advice that I gained from the forum. After 15 months on Friday the FOS confirmed that it would uphold all ppi cases from 3 separate loans that i have had in the past 10 years with LTSB that were all settled early:j. I currently have a separate loan with LTSB that is not loan protected. My question is can LTSB use the settlement amount from these 3 loans to reduce my current loan that I have with them. My own feeling are that this is a separate contract and that they cannot mess with this current loan.

    Please advise if you can

    Hi, if you have no arrears with Lloyds on all your other loans were paid up in full then I would say it would be wrong for LLoyds to pay this back to your current loan. Are you in arrears at all with the current loan or have had arrears with any of the loans? If you have/are then they would most probably be within their rights for doing this but otherswise they would not be. Have they actually said that this is how they are redressing the money?

    NoI have never missed a payment on any loan that i have had with lloyds tsb or I have never been in arrears. they have not said yet that this is what they are going to do but i'm very suspicious of banks and try to always think what their next move will be. PPI for he three loans probably adds up to around £9000 + interest. Glad to hear you feel the same way as me though. do you think i ought to ring the FOS and clarify this problem with them.

    Well done to you, that is very pleasing news.:T:beer::T

    There is no harm in contacting the FOS, if they dealt with this in the first place, then yes do raise this issue with them and be ahead of yourself here.

    My hubby is actually waiting on a payout via Credit Card PPI Lloyds TSB, the FOS resolved this later in 2009, and we have been chasing Lloyds up for a payment, even though the ombudsman closes the file, they are still willing to contact them as well, on your behalf to ask for an update on the refund, although the procedures are to contact Lloyds if you hear nothing of 4 weeks of the letter sent from the FOS, this was the case for hubby, he have contacted Lloyds several times, but he have not heard anything from them up to now. but hopefully you will receive your money when due.;)

    I know your not asking anything about this actual matter, but still worth you contacting the FOS if you want to.

    We are currently waiting for the decision on the loan ppi via Lloyds as well.

    hi Di,

    From experience LLoyds are taking 12-16 weeks to process the money - please check it though they don't always calculate correctly !!!

    Will have to double check hubby's letter, it may have been approx October he signed the acceptance for this, maybe early Nov, but the letter dated 4 DEC 09 said if he hears nothing by 4 weeks as from the dated letter to contact them, so I expect that is why he have not heard, because of the 12 - 16 weeks and backlogs I expect, cheers Tiggrae.;)
