Im hoping someone can help me please.
My wife has a loan with barclays bank, she borrowed £10k and still has a good few payments left,£270.81 per month until oct 2010.Almost £60 of that is PPI which my wife believes she was mis-sold.She wrote a letter to barclays using the template from ths website and got an immediate reply saying that her case will be dealt with by december 11th 2008, which was roughly 4-5 weeks after she sent it.December 11th came and went and no reply, she rang barclays and they said they needed another 3 weeks.Rang them again 3 weeks later and was told by barclays that there is such a demand for mis-sold PPI cases that her case hadn't yet been dealt with and it would be dealt with in due course. She rings them every friday only to be told same thing. What should she do now. What makes it even worse is we contacted barclays phonebank to remove the PPi from the loan repayments as we would be £60 per month better off but were told we couldn't.
Help us
Hi there
As is it 8 weeks they have this is actually ample time for them to investigate complaints, I assume there are more than 1 person dealing with these complaints, however you should now be eligible to take this to the financial ombudsman service (FOS) now at this stage, you have a choice here.
Give the FOS a ring and see what they advise and take it from there, they may send you a complaint form or you can download a form from the FOS site, but remember to also enclose a copy of the complaint form to the finance company and tell them you feel they have had ample time to investigate and you have not taken your complaint to the financial ombudsman service, (that is if you want to take this action), however there are other ways these can be dealt with, and I am sure others on here can confirm how.
If you decide to want to take this to the FOS, the finance company may still continue to investigate and hopefully it will go in your favour, if that is the case then you just let the FOS know.

after about 5 months i called egg to see if i could cancel the ppi and was told that it was inadvisable and i felt obligated to keep it.
I tried to reclaim it about 6 months ago, explining to egg that i had tried to cancel it before but had been put off unfairly. Egg said that they had no record of the call and so I could do nothing. I didnt know how true this was but didnt know wht else I could do.
I was recently tidying and realised I couldnt find the agreement i signed to take out the card. I requested a copy of this from egg and received it at the weekend. I have had a look at it and cannot see anywhere on it a mention of PPI. Therefore if i never signed for it could i demand it be repaid to me since technically there was no PPI in existence?
any ideas?
Hi there are you saying that on your agreement there is no mention of PPI?
Do you have the monthly statements for this at all by any chance?
Is it still an active account? The one and only "Dizzy Di"0 -

Write to them and cancel the PPI, and demand a refund of all premiums plus interest, as you are out of the FOS timescales you will need to try and get them to open up the complaint again and issue a final response.0 -
Hi, thanks for the reply. Yeah it is still an active account. I have the statements online. I cancelled th PPI when i originally comlained.
No there is no mention of the PPI. I have asked them to send me evidence that i have signed something agreeing to it, not just that i ticked a box when applying.
dunno what i can do to get it re-opened but if the basis of my complaint is different could i not start a new complaint?0 -

Hi again
Even if this was cancelled you still feel you have grounds for complaint and reclaim what you have paid in PPI, interest and charges occurred.
If they do not supply you further evidence, maybe you would have to request a SAR (Subject Access request), the downside of this is there is a charge of £10 cheque or postal order payment, but they have 40 days to comply to send everything they have on you on your account(s).
If you go back to the thread list there is a thread for SAR there you will find a template, delete what does not occur to you.
There are details of the SAR as well on that same page of the SAR thread.
They generally go back as far as 6 years in supplying what they have on you, but sometimes some are lucky to receive info going back even further.
However, you could contact the ICO - Information commissioners office, I will add the link below for you, this is an interesting website, and see what they have to say, good luck and please keep posting so we know when your ready to move on to the next step regarding your complaint.

Am I understanding correctly that you are setting up a reclaims company?
Do they just let anyone do it?DS1 12/10/04

There are lots of "jobs" that people do UNTRAINED.
I just help for free and do not make out to be an expert. Like Troness says, all experts start out as beginners. If you read what I said about the advice I got from some on here you would understand "being wary" to listen to "experts".
I would THINK everyone is that has had such terrible things done by brokers/lenders.
Then again some just don't care.0 -
The thing I find disapointing about some claims companies is that unless the FOS can help they can't take it any further, and these forums can do that for someone for nothing.DS1 12/10/04

I ask myself, what are they getting out of it!!
Although I am sure that some companies really do want to just "help".0 -
Marshallka you have me totally wrong, I haven't a clue about Tiggrae's claim company,I just knew her here.
I was agreeing with you that anyone can get set up and take peoples money for something that is done on these forums.
I started with a claims company and would have lost a lot of money if I had continued with them and they wouldn't have even gone as far as the courts.
When they wrote back and said it had to go to the FSCS if I hadn't cancelled them then and there I would have been paying them 25% for doing nothing.
That is 25% of the amount that would have been taken off the loan that I wouldn't have seen and so I would have owed the claim company money!!!
They don't explain that, I had to query it after I read it on another forum, they said I could pay them it by dIRECT DEBIT!!!!!
So believe me Marshallka I am as wary as you as I nearly ended paying a claim company £5000.DS1 12/10/04
