Thanks, I am claiming back PPI from Debenhams, or at least attempting to, there are several reasons for my claim, one of which is that I never agreed to the insurance on my store card, on my form I have the box which says 'I wish to purchase' is not filed in, yet I have been charged PPI since 2005 when I took out the card, I was also unemployed.
I have only recently managed to find the paperwork after reading Martins emails on this subject got me wondering.
As this forms part of my claim, I wondered if they would need to have copies of the docs.

I would hope they have this and I would only send this document to the FOS if you have to take it further( you can trust the FOS, not sure about Debenhams!) Let Debenhams know you have this agreement and the insurance is not ticked and go from there.

Have heard from the FOS in regards of the Endeavour/Hamilton Case, they have agreed that we write to them about the mis selling (which we have confirmed we have done), and if they do not resolve this for us then to send all the details to the FOS, and they also confirm if we hear nothing by the time 8 weeks have passed, to still continue to take this to the FOS.

    So fingers crossed folks.;)

Almost forgot to say, they did offer to write to them as well on our behalf at first, until we confirmed we have already done this a few days back.

Does this mean that Hamilton may have agreed to look at some cases?

Good news for you Di, have they said they are actually dealing with it or just looking into it then? A few on here and over at another site have been told they will have to see and that as yet this is all new about actually getting the complaint through the FOS.

I am confused. I thought FOS wrote to them ages ago for you?

Barclays have sent me a questionairre to fill in about how I applied for my PPI and if I was explained about T&C's, etc.
Has anyone else had this and should I fill it in? as I don't want to be caught out

I would just tell it like it was at the time. You cannot get caught out then. If there is anything you really cannot remember then you would be best to put "cannot remember" just in case they have proof of otherwise.

    Good luck

Should those of us who have had our PPI claims declined by CCC's be pro-active and chase them for a review, or, sit back and wait in the hope that they will contact us and inform us that they will be reviewing. I had claims declined in 2007 which were for the six years prior.

Or, am I being naive in thinking they will contact me ? I have two trains of thought on this, 1. request a review of my declined claims to the CCC's, 2. just go straight to the FOS.

Yes they did, they then wrote back to the FOS with no explanation but just HFC details.
However, we worked out its 6 months coming up at the end of this month, the FOS taken our situation into consideration as well, they said see what comes back with from Hamilton, and it will then be a matter of starting a new case, if this is not resolved, or if we hear nothing.

It maybe cos they are NOW taking the underwriters/insurers into account, where they didn't before......maybe??

They always took the underwriters on for rebates apparently. That is what that manager told me in the email I posted on here yesterday. I know for misselling complaints they have to have been agents I think. I assume that FOS and legal people can actually find that information out but we cannot cause they do not need to actually disclose commissions to us. They would have to the the authorities though.
