PPI Reclaiming Discussion part 4

I took out a loan in February 2008 with Sainsbury's Bank / Bank of Scotland and was told during a conversation with an adviser that I could be refused the loan if I did not take out the PPI and I explained to them I have an income protection policy which covers my salary if anything were to happen but this was disregarded and it was recommended that I take out the insurance, which I did reluctantly.
I complained about the PPI I was sold a few months later and later received a letter explaining the loan etc and declining my complaint. stating I can go to the ombudsman if required but this must be within 6 months of their letter dated August 08 is this correct?
or can I start a new claim on the basis of being overcharged?
Hello and welcome.
Yes unfortunately it is that of 6 months as from the date of their final letter, that the FOS will investigate.
However, if you have a personal reason that prevented you from continuing to go to the FOS at the time, you can write to the FOS and explain this to them, ask if they can reconsider investigating for you, or another way is to start all over again with the complain with the bank, but you will have to make them aware it's a brand new complaint.
It may be worth a try, so give it a go.
Not sure on what you mean about being overcharged??? Sorry..:o.The one and only "Dizzy Di"0 -
Hi all
After a year and a half of this process, the FOS adjudicator has sent me a letter finding in my favour (yay!) regarding my complaint about mis-selling of pPI on an Egg loan of a few years ago. Egg now have until 7th Aug to respond.
I'm getting the impression that Egg tend to drag their feet. In anyones experience, does Egg ever just agree with the adjudicator or is it more than likely to go to the Ombudsman? If it does go to the ombudsman, is it likely to uphold the findings of the adjudicator or has there been cases where they have gone in favour of the financial body?
Any info appreciated- thanks0 -
Hello Hugbubble, the FOS found in my favour and Egg didnt respond within the time frame and it has now been with the Ombudsman for just over a week,i believe it is likely my complaint will be upheld and it is very rare for cases to go the other way unless the adjudicator has overlooked something major.DS1 12/10/04

Hi Barloo69
I received an indepth form to complete when I first contacted the FSCS last August, stating my reasons for mis selling etc. Is this the one you are referring to or is this a 2nd one you have received.

Yes it is the first one. It would seem my claim didnt have one of the forms then.
Thanks..If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -
The FSCS confirmed that Twopart/eloan were "pending default", but not actually declared as yet.;)
So this date is yet to come.;)The one and only "Dizzy Di"0 -

Maybe they are using your claim as the one that will bring them in Default as they can't be in Default until there is a successful claim against them."We will not usually declare a firm in default unless we have received at least one claim against the firm that would come within our jurisdiction"DS1 12/10/04

Yes maybe your right there Pinknico, and as it's the first one as shown on the ref number it could well be.;)
I wonder if any of the others have heard the same from them as well, think one of them was joshesmum, can't remember the proper name lol, but there were a few here and there, that had put in a claim, so curious now.
Because "pending" would mean "awaiting" I think???The one and only "Dizzy Di"0 -
Yes you're right Di,will be good to see how long your one takes to give us some idea of timescale. xxDS1 12/10/04
