    Hello All,
    I have a personal loan of GBP 10,000 with bank of scotland, which I have been repaying since October 2007. When I took this loan, I was also given an insurance cover, which I did not know was optional. That was my first job after Uni here and I was still under probabtion. So I was told, the insurance will cover for any unemployment and since I am on probation, I should take it!
    Two months back I was made redundant and I called the halifax insurance to claim the cover. They advised me to register with the job centre plus and I will have to wait for the benefits claim's result. I told them I won't receive any benefits because I am not an UK or EU national. But they told me have to apply anyway. I did so and my benefits claim was refused as expected, saying that I "don't have any recourse to public funds". I sent all these documents to halifax and my claim for insurance cover was rejected. The letter was something like "since you don't have recourse to public funds we will not be able to proceed with your claim" !!
    Halifax says, the claims will be refused if you are not receiving benefits. And as a non-EU citizen I won't receive any benefits anyway.
    I contacted them several times, tried to explain my situation. Each time I got questions like "were you not paying taxes?" "were you not paying your NI contributions?" etc. Finally with much struggle I mananged to convince one of their agents that people outside EU are not eligible for benefits eventhough we pay taxes, NI contributions etc. She finally agreed that the policy is mis sold and advised me to lodge a complaint, which I did.
    Halifax keeps on senting letters saying the process is going on, but not result yet. It has been 6 weeks now. I saw from the article and other posts that it can take 8 weeks.
    I just wanted to ask if I am right that the policy was mis sold?
    Also the I paid the insurance amount as another credit being added on to my 10,000 loan. If halifax agrees that it is indeed mis sold, shouldn't I ask for the interest which I was paying too for the insurance credit?

    Hi there Sudheesh and welcome.;)

    So sorry to hear of your issues here.

    This just isn't fair as its worthless to you.

    I'm sure if Halifax does not resolve this for you then the Financial ombudsman service (FOS) will.


    They have 8 weeks to respond in full. If they do not favour this then write back until you receive the final decision. The final decision should give details of the FOS if your not satisfied with the outcome of your complaint.

    I was sold PPI from Picture, with a 50% rebate after two years. They now say they will not pay the rebate as I was late in paying on 3 occassions. My account is up to date and there was only 1 payment that did'nt occur in the correct month. I have written to the Ombudsmen, woundering if any one had a similar story.

    I think this have been known to happen to some, cannot recall who though, but hopefully the FOS will resolve this one for you, good luck.;)

    Hi all if egg or any company does not respond to the adjudicators findings do they then automaticly pass it on to the Ombudsman? If so what's the point in them not responding or making payment.Surly the FSA will find against them and maybe up the compo.

    Hi there that is just typical of these con merchamts they will do anything to get out of paying up you are probably aware of the hassle that some of us are having on here with regards to Picture and their PPI hope you get some satisifcation from them Good luck;)

    Hello Jacseb. I too am currently in communication with RBS about an old Natwest ppi loan that they missold to my parents some 5years ago. Although in my case Natwest sold the ppi on top of a joint loan application, we have now discovered that the ppi only actually covered my late father. This was clearly not as my mother believed and given that she was made redundant part way through the loan and she was considering making a claim, just before finding further employment and not needing too,substanciates that believe. The local Natwest branch was useless and after writing to head office, we have now received a "without predjudice" offer of £750!!!!. Is this Natwest standard first offer? The cost of the ppi loan was £1,229 although my parents did actually want the protection, they were left in no doubt that they were BOTH covered, when they clearly were not. Should we ask for the lot back with interest or cut our losses? Any advice?

    Yes this is the case.

    I think these loan/finance companies stall on purpose to be honest, its so annoying though isn't it and I think they hope it does go as far as the ombudsman himself, hoping they will have a different view, which would be very rare. Good luck hun, I'm sure the ombudsman will sort this out for you in your favour.;)
