    I wonder who works for a Solicitors or Ambulance chasing firm??

    Trust me even Solicitors do not know the difference between pre and post reg cases, and the fact that GISC provided a voluntary scheme before the FSA took over.

    So far every case I have received from a solicitor has quoted the Hurstanger case, and every time it has been dis-proved, as Solicitors do not read the paperwork given to the client at the time of the application, even if they initially do a SAR request!!!!

    My advice would still be to stay as far away from Claims firms whether they are Solicitors or not. To date I have never upheld a complaint from one of these company's, and neither has the FOS when they have been referred, and none of the cases have ended up in court as the Solicitors just try to use scare tactics of thretening court, but never actually go ahead with it.
    I would imagine that experts in Consumer credit solicitors etc would actually know things. Is that not what they trained and became "experts" in. :confused:

    And can I ask why you have "never" upheld a case from one of "these". Surely its unfair to judge someone that has used a claims firm just because they have. People use them who have little time to make the complaints and handle them themselves.

    Barclaycard haven't given me a deadline for them to have paid me by, but they have given me a summery of thier calculations of the refund. They also gave me a settlement sheet to sign and got me to give my bank details for them to pay straight in to my account. Is this how they have done it with you?

    Any chance of posting up their calculations (personal details removed of course) (by hand or Photobucket) ?

    Claims company's are of no use at all, pre-FSA or post-FSA, most of them don't understand the difference anyway. Solicitors try to use the Hurstanger case, but this only applies to a few loans, and the Solicitors don't obtain enough information prior to submitting a claim to work out if the Hurstanger case actually applies. Many claims company's get the client to do the work anyway, by making them answer pre-populated questions (which is against their code of practice), and then just put the answers into a standard letter. It is very rare (<1%) that a claim firm will actually take into consideration any of the information you have before submitting a claim. The stance thay take is, if you throw enough issues at a loan company one thing might stick.

    These company's will also give up if the FOS are unable to help, as they don't have the knowledge to case the case to court.

    Your best bet is too use the letters on this site, but make sure you personalise them, loan companys and brokers get loads of these each week, and complaints that have not been thought about, can be replied to by using set standard paragraphs.

    hi you've put on your signature here that you 'decline PPI complaints for a living' can I just ask who do you work for and if that's your job then is it your company's policy to decline PPI complaints when received ?

    I put my first letter through to claim back PPI on 24/3/09. I have received two letters since, the most recent being 18/5/09 stating they are not yet in a position to provide me with the outcome but they are still investigating. It has been nearly two months, am i supposed to just wait it out. Any suggestion appreciated.

    they are allowed 8 weeks in which to fully respond to your complaint - if you haven't received anything by week 10/12 then take your complaint to the financial ombudsman service - they won't look at it unless you've given them time to respond

    Hi Rachel

    If the full 8 weeks have passed and nothing is resolved, unless your prepared to wait until they send another letter, you should be entitled to take your complaint to the FOS.

    The choice is yours, maybe give them your own timescale if the 8 weeks have passed on and if you hear nothing by then, contact the FOS.

    Be aware though the volumes of these complaints are extortionately high with the FOS, so fingers crossed either way.;)

    It's been about 8 weeks since I sent a letter to A&L to complain about being mis-sold PPI.

    After a week I received a letter saying they'd got my letter and they would investigate.

    After 4 weeks I got a letter saying thanks for your patience but they will still investigating.

    Today, 2 days short of 8 weeks I got another letter saying they were still gathering information.

    Is this normal delaying tactics? what should I do now, write back and complain about the time they are taking or just wait it out?

    Any suggestions?

    Hi Phil

    They have kept in touch at regular intervals as it seems so that is a good sign, if you want to grin and bear this for a little longer and hopefully they will have resolved this for you in your favour.

    However, if it goes on too long, for example if you hear nothing by another fortnight, chase them up and tell them they have had ample time to deal with the complaint and if you do not hear by 7 days you will take your complaint to the ombudsman.

    As you know anyway its 8 full weeks they have, but as they have kept in touch regularly, hopefully this is a good sign, fingers crossed.;)
