    hiya guys,

I had a letter from the FOS today saying that FP disagrees with their findings, it is willing to make an offer in line with the FOS recommendations, save for the payment of distress and inconvience, in full and final settlement of the complaint. FP is making this offer as a gesture of goodwill without any admission of liability.

FOS saying I need to consider this offer. This offer from FP is less than redress that I indicated in my assessment and and this payment doesnt include payment for distress and inconvience:mad:

    its also says...
your case could be referred for an ombudsmans final decision in which case I consider it likely that an award would be made for distress and inconvience not with standing this you may wish to consider this offer?:confused:

the compensation amount the FOS asked for was £500

so am I right in thinking that they offer is lower than the FOS asked for and they not paying compen out?

Do you think the FOS seem confident that I will get the whole lot of if I ask the FOS for final decision? I am scared they go with FP and I get nothing

    Help please lol

    thanks Livy.xxx

    Hi Livy

Sorry to hear of your ordeal here.

And please wait for other opinions as well before you make a decision.

Right if this was me, then personally I would not take this offer, I bet there is a huge difference in the amounts there as well, if you want to bear with this longer, and not satisfied then the adjudicator will move this on for you, if this is the case, let the FOS your not happy with this offer and feel you are going to be well out of pocket with this low offer, and you still stand on the same ground that you were mis sold this policy, where you want this moved on to the ombudsman.

It is your choice here hun, but personally as this is my opinion only, I would fight for every penny.;)

    Good luck.

Hi all, I am in need of some advice please as getting very confused. I am trying to reclaim for PPI on a loan I took out in May 2001. I purchased a car on HP at Hartwell Ford and the finance was arranged with GE Money. I completed the payments in April 2006 and shortly after began trying to reclaim my ppi - £50 per month. Initially I approached GE Money with the template letter from this site and was told that I need to take the issue up with Hartwell Ford. I contacted Hartwell who have told me that they wern't covered by the FSA at that time and so I have no claim.
Firstly, should I be pursuing Hartwell or GE Money? And in which case what should be my next move? As far as I am aware Hartwell where not covered by the FLA either??
Any advice would be much appreciated - many thanks all x
Hi it would be Hartwell you pursued as they 'sold' the policy to you, however, as the policy was sold in 2001, that's 8 years ago and the Statute of Limitations Act 1980 limits the claim of a 'debt' to 6 years. As Hartwell weren't covered by the Financial Services Authority you couldn't take your claim to the Financial Ombudsman, but you could start proceedings in the County Court. If you do you unfortunately run the risk of Hartwell applying to have the claim struck out as being 'time barred' and as such you run the risk of losing the claim and having to pay the defendants costs - which won't be insubstantial !!!

your shouldn't have to much trouble - if they deny your claim (as is standard) as your loan was taken out after the 12.01.2005 (which is when they came under the compulsory jurisdiction of the Financial Ombudsman Service) you can take your complaint to them !!

I agree - you need to check you've got your calculation correct before you reject the offer - if you have then definately reject it - but if it has to go to the main ombudsman (your case will be currently being dealt with by an adjudicator) it could take another 6 months before he is able to rule !!

isnt it a pain in the neck when you have to wait a long time, you would think the fos could operate a faster system than the one they have got!! this is like the inland revenue, if you owe tax you must pay it back straight away, but if they owe you a refund you have to wait, suppose its all par for the course lol good job we brits are patient. (up to a point)

    Hi hun

You do what you feel is right.;)

If your current financial situation has worsened, let the adjudicator know, and request if this could be fast tracked, then their manager will take a look and consider this, if they agree they should move your case on quicker for you to the ombudsman.
    Good luck.;)X

it is - but in saying that they do do a good job !!! Their big problem is being innudated with complaints and being understaffed - at the moment I believe they are only starting to deal with complaints from March of 2008 !!!!
