Its good to hear from you and hope your well, sorry to hear of all the messing around with your cases.
In regards to the questionaire what many have done is sent the form back with a letter, and stated they have not completed the questionaire because they should already hold these details from when they sold you the policy.;)
They still have to continue within the timescales they have.
The questionaire is your choice if you want to complete, but really its just another stalling tactic.

Thanks Di yeah im good thanks, i hope u are, so is the time frame from when i sent the first letter requesting refund, or from the last letter? and no i dont think i will fill it in, i will do as you suggested and send a letter returning it. I was suprised to recieve my ppi back from cap one and then they refuse the charges, do they think i am gonna give up or summit cause im not. I will keep going lol and how long is it that i should hear from the FO any ideas? xxxx

They have 8 weeks in full from the first letter, however, sometimes they let you know they need a little longer, it will be then up to you if you want to wait, or continue to go to the FOS.
Great on CAP ONE PPI, well done :beer::T:beer:, good luck with the charges side of things too. Good your keeping at them.
The FOS can vary, I take it they are starting to move on the last few weeks, so maybe they have taken on more adjudicators again.
This can take anything from a few weeks, as soon as its with the adjudicator, if it gets too complexed, like the other party may try to make things a little harder with timescales etc, or they may refuse where the FOS believe it should be upheld in your favour, if this is the case then its moved on to another adjudicator who works closely with the ombudsman himself.
I'm sure you have a good case here hun, fingers crossed.;)

I used the stage one letter regarding the missold PPI on my loan from 3 years ago, i sent this on the 19th February 2009, i received an acknowledgement back saying that they will look into my complaint and contact me its now the 22nd April and i have still heard nothing. I have read through the stage two letter but feel that this does not really cover this please help!!

Did you post your letter by recorded delivery to ensure they received it?
They have 8 weeks in full to respond, if you hear nothing at all then you can ask the Financial ombudsman service if they are able to investigate this for you.;)The one and only "Dizzy Di"0 -

Yeah i hope i do lol just abit worried as requested SARs from them all and they just sent my statements again, waste of money, so all phone calls i made i have not got any records and not sure if they have them either, not sure if this will go against me. Also studio are saying i did the ppi over the internet in 2004, i know for a fact that i didnt have, or have access to this at the time and i was sold this over the phone, but how can i prove, or they disprove this? my mind is boggling. xxx

If you think information was missing from the SAR, you can contact them to tell them so, also any problem the Information Commissioners Office (ICO), can help in these cases, to make sure you receive all the info you should have received within the SAR, may be worth you calling them if you feel something is not right:

Well i did ask for all telephone calls and i have not recieved anything apart ,from the statements, i had to have debt management with the CCCS and this is not show either, i do think that something is amiss as there has been corrispondence between the CCCS and the companies and this isnt even mentioned. One company have said that they dont have that information. They will squirm by the time i have finished with them, they got me into debt, they can bloody well get me out of it too. grrrrrrrr. Hi I dont seem to be getting anywhere with FP now just a question if I am to pursue Loans.co.uk where do I write to when I google it, goes onto a different website - does that mean they are now no longer? And I wont get my money back?
My dad is getting help from a company called Heenans and apparently after reading the small print they dont charge for their services as they want justice for the claimant? My mum and dad took a loan out and at the time my dad was in hospital and my mum agreed to the loan they told her it would be less but turned out nearly £70 a month more she then realised there was PPI on it and hadnt agreed to anything this was done thru the RBS so will be interesting to see if they come up with the cash and if so, how quickly will keep you posted.
On my finances well I got my car sold today but the guy hasnt paid for it nor has he contacted me so getting a little bit angry and annoyed as I saw a nice one on ebay and want to bid for it much smaller than my Touran and half the Road Tax god for what I paid in 6 months I would get it done for a year and a half lol :rotfl:

Hi Di and evening to all, i hope your all ok, i havnt posted for a while, just to recap i was claiming ppi and charges for my credit cards on barclays, cap one, sky, studio and now citi. I recieved ppi back from 2 cap ones on the second letters but they are refusing to pay the charges back, so sent letters to the FO. Studio paid all charges back on the first letter but refusing the ppi, so letter sent to FO. Sky just refused all after the first letter sending me the final response, so you guessed it letter sent to FO. Now barclays refused both ppi and charges after second letter, i requested they look at it again and they sent me 2 letters saying they are looking into my complain again and today they have sent me a questionaire, do i have to fill this in and send it back? Sorry for waffling but its all i seem to do is write letters, copy letters ect ect, more advice would be great please. Thanks again. Sarah xxxxx
Hello Sarah, don't worry about getting charges back from Cap1 and Barclays, you will get these back. I think it took about 6-8 weeks when I sent my complaint about Cap1 to the FOS. Barclays should be the same.xDS1 12/10/04

Our Understanding of your Complaint:
I understand your Barclaycard Visa account was registered for the Payment Protection Insurance but you have stated that you believe the policy was mis-sold and you have aske for a full refund of premiums paid.
Background to the events leading to your complaint:
The Payment Protection commenced on your account on the xxxxxxxx 1996 and a policy document was sent to you few days later. You had a 30 day cooling off period in which to examine the document, decide if it was suitable for you and cancel it if necessary.
The policy was cancelled at your request on xxxxxxx 2006. You have not previously queried any of the charges applied to the account for the previous years.
What we have done to resolve your complaint:
We have reviewed our individual case and informed you that the policy was valid and agreed to on the xxxxxxxx 1996.
Summary of our Internal Investigation:
A Payment Protection policy document was sent to you in xxxxxxxx 1996 when your account was registered for this insurance. It was your responsibility to read this document and decide if the policy was suitable for you.
Your policy schedule, detailing the benefits and exclusions of the cover, was sent to your home address and included within the schedule was your right to cancel the policy. This advised that the policy could be cancelled at any time, and if cancelled within 30 days of the cover commencing any premiums paid were refundable.
The policy schedule was sent to you detailing the full product information enabling you to make an informed decision. The premiums which you have been paying since you have opened your account have been to provide insurance for Life, Accident, Sickness and Involuntary Unemployment.
In the circumstances, I must advise that compensation is not applicable in this case.
Our "Conditions of Use" state that it is your responsibility to ensure that your spending is reconciled each month against your statement. Payment Protection Insurance was shown on each statement and communication should have been made to Barclaycard in order to rectify this.
I am sorry this is not the outcome you wanted, however, I hope my explanation is helpful. For the purposes of the Financial Ombudsman Service you may regard this letter as our "Final Response" to your complaint.
You will find more information about the Financial Ombudsman Service in the enclosed leaflet. Please note you have six months from the date of this letter to refer to the Financial Ombudsman Service for investigation.

My next step after receiving this was to take it to the Financial Ombudsman, where I received the complaint form to fill in. We filled it in, sent it off and after an age of waiting as understandably the FOS and the Banking/Card services are snowed under with PPI complaints, we received an offer from Barclaycard. The exact amount we do not know yet, but this should be forthcoming in the next few weeks where we will be able to view the calculation. If we disagree with the offer then we re-complain to the FOS.
Just remember, even when they fob you off, don't give up, take it to the next step. That is what they want you to do and they will do their utmost to put in your mind that it is not worth it. Keep going and DON'T GIVE UP!

Its more or less the same as the letter they sent me except for an extra paragraph about the time barred thing.
I have my fingers crossed (and everything else) and hope I get a positive response from FOS soon.
