    Sorry you had to wait so long. I know some people seem to have to wait a long time for their refunds. Think the lenders are very busy at the moment. Understand your comment though that it would be different if it was the other way round. Fingers crossed it will not be too much longer for you.

    I was told by my case worker that I would get my money back within a month as I wanted it put into my Tesco savings account. The FOS faxed my acceptance letter back to them last Monday. I am going to ring them after Easter but reading what you and Natalie have said I do not hold much hope. Like you say I wonder what would happen if I went into Tesco, did my shopping then told them I would pay in six weeks time.

    Good morning all!!!!

    Just a quick update on my claim with Cap One..... I received a letter from them on Sat morning basically saying that they still maintain that my PPI was not mis-sold and have offered me a 'Good will gesture' !! Now there's a few points I need advice on please?? :rolleyes:

    1. They are obviously only offering me a partial amount of premiums paid and I know it should be at least 4 times that amount!!

    2. I wrote to with a SAR a couple of weeks ago.....they have cashed my £10 cheque but I don't have any info.....should I wait for this before replying??

    3. They have stated in their letter that if I accept this good will gesture, they will reduce this amount from my outstanding balance......My account has never been in arrears and I have never missed a payment!!

    I would really appreciate some help as to what to write in my reply :o

    Hi there scoodies. Beware of goodwill gestures why would a company give you money if they are not in the wrong:confused: I would suggest that you write back to them and say it is not acceptable and that you are willing to take this to the FOS. Give them another two weeks and post by recorded delivery. They have 40 days to respond to a SAR. In the meantime the SAR info should be back. If you are not certain you have a good case or you need the money urgently then obviously accept. It may be worth giving them another chance they may up the offer. There again they may withdrw it completely.

    May I suggest in the first place that you ring the FOS and ask their advice.

    Hi Scoodies.

    If your not happy with the offer of goodwill, you should have the opportunity to take your complaint to the FOS, I know I would if there is a big difference amount, like yours.

    In regards of the SAR, they have 40 days, if that time is has passed you can call the Information Commissioners Office, here:
    https://www.ico.gov.uk/Global/contact_us.aspx
    They should help you out here, but before that maybe contact them and tell them, the 40 day dead-line has come and gone, if they don't forward you the SAR request within a few days, which you are required to give them, you will contact the ICO.

    However, if the 40 days have not passed yet but the time is almost here, ring them to remind them, or send them a reminder in writing.

    In your last query, if you've not missed any payments - no arrears, I believe you should be given the opportunity to have this paid directly to you, but maybe every company varies from one to the other, but sure this is the case here.

    In "my opinion", I would not accept it, if they do not higher the amount to a more satisfactory total, I would move this on to the FOS.;)

    My husband took PPI insurance with his Capital One credit card back in 2003. Last summer he was diagnosed with a chronic heart problem. It took me a while to realise we had insurance to pay the credit card (which had a very high balance) but eventually I made a claim.

    Now, I realise we have paid some high premiums over a long period of time but thank goodness we did. AXA, the insurance company which has been handling the claim, has been first class, speaking with me once they had the written go-ahead to do so from my husband, explaining to me what was going to happen, checking the situation hadn't changed in a most considerate way (they must do this of course as many medical conditions improve, but the way in which they do it is very thoughtful and not stressful).

    This insurance claim has made a huge difference to stress levels in our household, something which is very important for someone with a heart condition.

    hi there. i agree with what di and max have said, this is a stalling tactic in the hopes you give up, i wouldnt accept a goodwill payment, take this to fos. good luck and please keep us posted

    hi there, glad you could claim on your ppi. this can sometimes be a very good thing to have, but alas not in all cases sadly, hence sites like this, i agree with you about axa they are an excellent company

    no wonder barclays are taking this course of action, the money they are making from barclays loans and fp loans with rip off ppi will give them cause for concern as their profits will plummet, i hope they lose this battle just like they are losing the mis sell battle. onwards and upwards
