Barclays challenges restrictions on loan-insurance sales
The banking giant is to challenge the Competition Commission's findings into the sale of payment protection insurance
Barclays has launched an appeal against the Competition Commission's findings following its two-year investigation into the sale of payment protection insurance (PPI).
The banking giant, which lodged its appeal with the Competition Appeal Tribunal (CAT) yesterday, is to challenge proposals by the commission to curb the sale of the insurance, which covers debt repayments if a borrower cannot work because of accident, sickness or unemployment.
In a damning report, published in January, the commission ordered a ban on the sale of PPI alongside credit cards and loans. In what was widely seen as a victory for consumers, it said that from 2010 banks and retailers making a loan or credit offer must wait a week before they can sell PPI to the borrower.
Barclays has asked for a judicial review of the proposal arguing that it is not justified by the evidence that the commission has provided. It also said that the commission's report was flawed, as its definition of the PPI market was too narrow and did not account for recent innovations.
Barclays said: "The appeal does not challenge the whole report but is targeted specifically against two points. The main area of concern is the point of sale ban which, it is felt, is not justified by the evidence that has been provided. Additionally, the scope of the market definition set by the Competition Commission is being challenged.
"The decision to appeal these points has not been taken lightly. However, Barclays will continue working on the implementation of all of the remedies contained in the Competition Commission's report as they are applicable whilst the appeal is ongoing."
It is not clear how long the CAT will take to consider an appeal, although a ruling before the autumn looks unlikely. Last month it upheld an appeal by Tesco, the supermarket chain, against a new competition test that would make it harder for the supermarket chain to open new stores or expand existing premises. That case took eight months from start to finish. The one and only "Dizzy Di"0 -
Hi all,
just an update on my Tesco loan ppi complaint. I called on fri to see how it was progressing and i was told they have a deadline date of 23/04/09. When i pointed out i sent my acceptance back to fos on 30/1/09, my caseworker says the fos send them in bulk so they did not receive this until the 26/02/09 so in actual fact its 6-8 weeks from then. Only a few weeks to go now but really could have done with this money sooner. Think it would be a different story if i was due them money.0
