    :huh:Hi I have had a rummage through our filing cabinet. And I came across a loan agreement from First National for some double glazing we brought from Anglian Windows. The Anglian salesman told us that the PPI was compulsary in order to have the finance. The loan agreement was signed on the 08/5/2005 the insurance started on 27/06/2005 and ended on 28/06/2010 it shows a lump sum of £662.39 for premium incl IPT. Can we claim? Who do we claim against?     Your first point of call is to Anglian Windows. I suspect they will deny it but, be it double glazing or a credit card, you have the right to claim back as being misold.

    Fraud Act 2006

    Fraud by false representation

    (1)A person is in breach of this section if he—

    (a)dishonestly makes a false representation, and

    (b)intends, by making the representation—

    (i)to make a gain for himself or another, or

    (ii)to cause loss to another or to expose another to a risk of loss.

    (2)A representation is false if—

    (a)it is untrue or misleading, and

    (b)the person making it knows that it is, or might be, untrue or misleading.

    Those in bold refer to your case.

  • Hi. Thankyou for your quick reply. i dont have any paperwork at the moment and the bank is not helping me at all. they are just saying " wait until you recieve your final responce letter "

    all i know is that i have made £381 payments a month for 83 months.

    i suppose i better just wait until hsbc contact me with a figure.

    By the way i think i have worked out that my ppi payment including the 8.9% interest works out at £162 a month.
    Because a £15,000 loan over 8 years is £219 a month with interrest and i have been paying £381.

    so if you minus £219 from 381 equals £162 extra that i was paying.

    does that make any sense or have i got it wrong.

    because a loan for £15,000 with 8.9% interest WITHOUT ppi added only earns them £21,024 over 8 years.........BUT with ppi added all in with 8.9% earns them £36,576 over 8 years.

    i call that PURE GREED by the banks.

    hope this is making sense.

    I sent the initial letter to Barlclaycard, asking for a copy of my original credit agreement within 12 days (I used the MSE template).

    I received a standard letter in reply on 20 October, to acknowledge receipt and advising me they were dealing with my request and would respond as soon as possible.

    Is it acceptable to have a delay at this early 'information gathering' stage?
    To they have to provide the information I requested within 12 days, or just acknowledge me?

    Very greedy and some :D
    You will get back the ppi monthy amount you have paid back,make sure that the loan is reset and the whole ppi is taken off the balance and that it continues to the term end of the loan with the ppi.

    The 8% is for each monthly ppi payment,this decreases the nearer it gets to the mis sell payout date,this 8% is not on your loan from the get go,so your monthly ppi figure needs adjusting.

    If you need any help with the figures when you get them,post them on here and someone will confirm if they are correct.

    They will need time to find this,give them another week and if you have no response,then ring and ask for an update.
    Did you pay £1 or £10,if you Paid a £1 and the loan was finished a while ago,they may write back and say they have no details and do not have to supply you with this.
    If it was £10 they have 40 days to find the info you need.

    Hi,

    I was just wondering if anyone on here has had any success claiming back ppi from g e money and british credit trust.

    G E Money (mortgage) are actually looking at my claim today and i have been told to ring back the middle of next week as they will have reached a decision by then.

    British credit trust have sent out a final decision letter which has been checked by the manager. They tell me i should recieve this letter either tomorrow or early next week. They said in a telephone conversation that they cannot access the information to let me know if my claim has been upheld or not. (do you think what they say is true or are they sending me bad news via the post and so wont tell me over the phone incase i throw a wobbly)

    A final decision letter normally means they are saying no, when you get it, we need to know what grounds they base this on

    Yes it is but dont panic, first we need to see what they say first and then you can tell me your story and I will do a letter for you
