    Got calculations yesterday from LTSB there trying to say now that they've already paid out on the bigger loan and only need to address the little un, a grand sum of 88.00 and 112.00 interest, there saying they have very little info now, mind you i suppose it was 16 years ago lol, there now looking into the credit cards again, they seem to take it a bit more seriously when you put a fos questionaire in and now the fos are involved they do seem to be taking it on board at last.

Anyway the other week I checked on Experian and found all the names of the banks where we had credit from and the date started and dates when we cleared the accounts which was great and a good start, then I was checking something on my bank account and I noticed that they keep a record of card numbers which again was fantastic so i filled out the form with as much details as possible stating that I wish to re-claim any PPI paid this is directed firstly at EGG. I sent all letters by recorded delivery.

    Anyway we both got letters back from EGG saying that they had received our complaints and would deal with them in the specified time required. Then a couple of days later my husband received a letter saying that he had never taken out the PPI and therefore not paid it and not entitled to a reclaim so they had closed his complaint, but in the letter at the bottom it says, "Unless you are able to provide any additional information or evidence, which would affect the decision your complaint will remain closed". So we thought OK then obviously we didn't pay PPI and left it there.

    He took his card out in Jan 2002 and mine in June 2002 the same year.

    Anyway the other morning something prompted me to see if we could access his egg account, then we decided not to bother as we asked for the account to be closed as they had put our interest up from 16% to something like 24% when we have a good credit, so we probably wouldn't be able to access the account. Then at teatime on 29th Sept something prompted made me to think I'll check on my account so I logged on and could not remember my password so phoned them and they reset my password, I logged into my account and to my surprise the account was still there and I was able to get statements back to October 2009 and there was PPI at approx £45 plus added to my statements. You can imagine how happy I was. Anyway I tried to copy them out put my printer was not working so I saved them onto my computer. When my husband got home that night around 10pm we phoned egg to ask for them to reset his password which they did and when we logged we could not get any of his statements and it said that no egg accounts to display at this time which we thought was very funny as I could access mine back to October 2009. THEN on the 1st October I got an email saying that I had got a secure message on my egg account so on the 2nd October I logged on and low and behold all my statements had gone and it was displaying "No egg accounts to be displayed at this time" same as my husbands, which I find a bit suspicious as we had made claims and they have taken our statements off (lucky for me I had saved mine on the computer). I have sent them an email today 3rd October asking them why my statements have vanished so am just waiting for a reply. But I think there seems to be something fishy considering them statements must have been on my account for two years then we try and make a claim and they all of a sudden disappear. I am still waiting a reply from my claim. I just wondered if you have heard anything like this before and can you advise me if there is any other way in which we can get my husbands statements. I will email them today and ask them also.

    Also I contacted CAHOOT asking for a copy of my statements and they said that I will have to pay £5.00 per statement, is this right??

    Sorry to go on a bit but it just seems very strange to me and I feel that something underhanded is going on.

    Hi clark as our lovely amersall said yesterday sar them as it will be cheaper, more importantly stick to you guns i've had this with LTSb now, i have been fighting them for the last 6 months to prove that i've got ppi, i know i had it, i've even sarred them and only got half the info sent to me as they tell me they have no info but keep pushing sending emails and letters to the ceo, failing that threaten to get the fos involved.LTSB have now finally admitted what i knew all along that i had ppi, i'm expecting to get offers on the cards next, i feel vindicated as i knew i had ppi in the first place but the bank just wanted to get out of paying me. all the best with this.

    ...and yeah shame about the score but it's been soooooooo long since we made it to a final, save a fortune on strips, and trackies and all the merchandise.

    I really appreciate your comments following my earlier post. What you have said sums-up very well the following point I made in my appeal letter - "In addition, the credit card and its benefits were being promoted in-store by a Marks and Spencer representative. Whether they were specifically representing home-ware items, groceries, money or lingerie is of little relevance – their primary duty that day was recommending M&S credit cards to customers, encouraging us to complete the application form, and were representing the Marks and Spencer company as a whole."

    It matters not to me if the person with the clipboard was the CEO of M&S Money or the chap who cleans the loos in the store's local branch - if they were assigned the duty of promoting the credit card and encouraging shoppers to sign up for it (even if only for that one day), then it's my belief that they were representing M&S Money as well as the brand/company as a whole and should have been competent to advise and qualified accordingly.

    Keep smiling... I daresay we'll get there in the end... :)

    Hi lovely your right there if someone was selling insurance for m&s then they should have been licensed this, will be another point in your arsenal and you have them on this point as well as them advising you to take out the ppi your on solid ground here girl.

    Well... thanks to Cappo (and MagpieCottage, for the post about the FSA rule which came in very handy!)... here is my appeal letter to M&S Money...:

    Thank you for your letter of 7 October, in which you reject my complaint of mis-sold PPI on the above credit card account.

    I appreciate the time and effort you took to investigate my complaint. However, I wish to appeal against your finding on the following basis:

    On the application form, a copy of which you enclosed with the pertinent section highlighted (copy included with this letter), you will see that the last line – in bold lettering with a sample cross beside the box – states “We strongly recommend you take cover by ticking this box”. I have sought independent financial advice and am told that this emboldened statement constitutes an “advised/recommended sale”.

    In addition, the credit card and its benefits were being promoted in-store by a Marks and Spencer representative. Whether they were specifically representing home-ware items, groceries, money or lingerie is of little relevance – their primary duty that day was recommending M&S credit cards to customers, encouraging us to complete the application form, and were representing the Marks and Spencer company as a whole.

    To answer your points about why I never previously queried the PPI, firstly, as outlined above you strongly recommended that the cover was taken out and, secondly, FSA Rule DISP App 3.3.6G says, "The firm should not reject a complaint because the complainant failed to exercise the right to cancel the policy."

    I should therefore be grateful if you would reconsider my complaint and my request to refund the full amount of PPI paid on this credit card account, plus interest, in accordance with the FSA’s rulings.

    I look forward to hearing from you as soon as possible.

    Good letter ruth i can't see them disputing this one why not also send hsbc's ceo an email as well ,i believe they own m&s's insurance side (i think)

    Hi i'd push this, i'm now getting exactly the same from HSBC there saying that they only go back 6 years unluckily for them this is the one the solicitors have got, we've sarred them but if they won't send the sar the soliciticors will estimate the "missing" premiums, we'll probably have to take them to court mind.
  • Ok so i had a successful claim from Lloyds tsb, they sent me all the letters saying they would be sending me a cheque, this morning i logged on to my bank account to find that they had deducted the ppi repayment from a current loan i have out with them which has never had ppi with them on it,
    my question is are they allowed to do this ?
