    Hi hun

Hopefully it will be a good outcome - when you do receive the response, but yes you are now able to continue to take this to the FOS now and let them know on the form that you've had no full response although the 8 weeks have passed and enclose copies of the letters you have received so far.

You can download a form from the FOS site or ring them:
    http://www.financial-ombudsman.org.uk/consumer/complaints.htm

I would also send a completed copy to Barclays to make them aware you've taken this to the FOS and enclose a form for their interest/records.
This way they can still make a decision - quicker as well, if they do let the FOS know especially if its resolved, obviously while your complaint is within the FOS inform them of anything you hear from Barclays, good luck.;)

Well, after sending out PPI claim on 13th February (thanks to all your kind advice), I received an interum reply on 26th Feb (dated 18th feb) acknowledging my complaint and reaffirming that Halifax are allowed 8 weeks to investigate. I am claiming due to not being asked about previous medical conditions and because the selling of the policy was aggressive, so I felt that I couldn't say no.

This morning I received another letter, dated 5th March, which states that the review manager has considered the information available to them:

'...in view of the fact that you are a valued customer, I have decided to pay you an amount which will put you back in the position you would have been in had you not taken out the insurance. This is done without admission of liability and in full and final settlement of your complaint about the PPI on your card.'

They are sending out details of the amount 'shortly'. Initially I was almost dancing (I've had sooo many problems with Halifax in the past that, any little victory is delicious :D) but now I'm wondering what this amount will be?

I have had this card since 2001, paid it off in 2002, then started using it again in 2003. The debt is all to do with house moves and I have moved a LOT in the last 6 years, mostly because of my health. I would really like the amount to shift a good bit off my current debt as, TBH, it has been the PPI which has pushed it up considerably. I'm now worried because I'm quite unwell at the moment and I really don't want to have to go to the financial ombudsman, but I will if they offer an amount under £1,500.

I'm a bit carp at figures and I didn't ask for, or calculate any amounts. Can anyone give me some pointers as to how to go about getting some sort of estimate? What information do I need and how do I calculate a ball-park figure which would be fair?

Thanks guys for all your help and support so far :T

As far as i'm aware putting you back in the position you should be in if you hadn't taken the PPI means a full refund and contractual interest, not statutory, as you will not be back in the correct position with the card provider being in an advantageous position.17% compound is a lot better than 8% simple.

    Good luck

Of course--but see my post 1983

Do you personally have experience of the process, the risks, the law ,the POC reqd and the time period of going for Contractual Interest?

    Thanks in advance

Im also claiming PPI from Lloyds of loans and a credit card so I wish you well and let me know how you get on ;)

Ask them to send you a full written form of breakdown of calculations, if there is a huge difference in the amounts and you feel your not satisifed with this amount they offered, and if they do not higher this on request you should be given the opportunity to take this to the financial ombudsman service.
If you do not know the actual full amount of PPI, its may be worth you requesting them to send you the breakdown of this for as soon as possible so you have time to make a decision, good luck.;)

  • Thanks Di, I did notice you had mentioned you had been successful with your Lloyds credit card, WELL DONE! .
Im going to apply for that first cause im having problems at the mo with getting copies of the 13 loans. Ive got 6 but still awaiting the others and they are dragging their heals sending a copy of the current loan agreement which my boyfriend took out on 02Feb this year.
He`s been into the branch and for some reason they fob him off and say they dont have a copy yet its amazing how they produced the loan there and then for him to sign within 5mins when they advised him to take out the top up loan to pay off his Lloyds credit card!!
I think im going to have a bit of a battle with Lloyds from the looks of things.
Is it by doing the SAR letter that I can request copies of the loans?
