  • Hi all now that the judical revue has won the battle for the honest working people can i have some hopeful advice from the good public out there ........ The rbs has objected to the fos that 4 ppi's i had against them had been timed out (gone past the 6 mth time limit) do i write back to the rbs and ask them to look into it again......... Kiind regards

    Hello there

    Even though there was a good outcome last week, its highly possibly the judgement will be appealed upon, but basically due to the judgement result, they should be looking into past sales and possibly re-opening cases anyway.
    What I would do in your case is contact the Financial ombudsman service in office hours next week, explain the situation of your cases being timed out, they may suggest that you write to RBS again due to the outcome of the judgement, you can then confirm this to RBS on complaining.


    The BBA have until the 10 May 2011 to decide to make an appeal, and due to this complaints have still been held up in the banks, but do give the FOS a ring direct who will give the best options on this since the judgement, good luck and please keep us posted.

    Good Morning - thanks for the info.

    So am I correct in assuming that if they don't appeal by the 10th May 2011, then there will be no appeal ?? and if there is no appeal then all the on-hold cases will have to be dealt with ??

    Also got another newbie question - does this apply to all PPI insurance applied to any lending product ?? such as credit card, mortgage and HP ??

    Hi Mich and your welcome.;)

    Yes I believe that is correct, they will then continue to get on with the reclaims.

    I am aware as well even if it did go to appeal and "IF" the BBA does end up winning, it does not mean they will not pay out, so either way they will have to investigate.

    And yes it goes for any PPI product.:);)

    Hi, I had front loaded PPI on my GE mortgage. I have since claimed on the policy for 9 months about 3 years ago. My question is can i claim as missold as it wasn't explained to me that only I and not my wife would be eligible to claim and i didn't realise i would be paying this over the term of the mortgage and now i have claimed once i am not eligible to claim again even though i have 16 years outstanding on my mortgage. Thanks.:mad:

    Its possible, but in regards of mortgage ppi I'm sure Dunstonh will be able to help.

    However, if you successful on a claim for example sickness/unemployment etc, and if successful for a reclaim, the refund will be reduced - due to some being used.

    There is more details on Martin's comments below here;

    Have you already claimed on the insurance?
    Until Jan 2010 it had been generally assumed you could not make a misselling complaint if you've already made a successful insurance claim. Yet proposals from the regulator now mean more people could be entitled to compensation.

    Anyone who has claimed on a PPI policy can still submit a misselling complaint, though the chances of success are unclear. However even if you're not successful you may be able to cancel your insurance.

    Hi there all,

    I received a letter today to say mt PPI claim had been successful - im owed £2900 but they have taken it off my loan instead of paying me? Is that right??? :(

    Hi Gary

    First of all Congratulations on your success!:beer:

    If there were no arrears, I think you could argue that you believe you are entitled to receive the full refund because you were out of pocket due to being mis sold the product in the first place, what I do know is if there is outstanding arrears they will award the refund towards that, anything remaining plus interest is normally awarded directly to you.

    However, they could differ from bank to bank, but if there were no arrears, you could write and ask them if they would kindly refund the award to you. (Also if there was something else, such as a certin debt, for example mortgage arrears/rent/council tax, maybe you wanted to use the money towards any of them etc. And argue on those grounds).

  • hi new to this kind of thing looking for advice me and my ex partner took out a joint loan with the rbs and they sold us ppi in my ex partner name because she has now went bankrupt can i make a claim for it as im still paying the loan thanks in advance

    Hi there,We can help you with the mis sell aspect, but as your ex is bankrupt then that is something we are not "savvy" on.
    You should post this on the bankruptcy board to get more valuable advice from people who know more. Title it
    joint ppi mis sell, ex bankrupt.
