My husband & I both took out personal loans of £5000 each with PPI over a 3 year period, starting 2006 and ending nov 2009.
I would really like to see if we can claim anything back as we really paid a lot for our loans over the 3 yr period.
The only problem is the loans were taken out with the bank we still have our current, savings and mortgage accounts with.
If I contact them and try to reclaim the PPI from these loans, does anyone think this will have a bearing on our day-to-day banking from now on?
Is there anything they are allowed to do, like ask us to close accounts, etc if we are successful at reclaiming?
I'm worried as, besides charging us PPI, we have never had any problems with this bank and I don't want to create any ripples in the pond that may hinder us in any future banking.
Any advice would be greatly appreciated, especially from anyone in the same situation!0 -

I am in default with my Egg Loan and Egg credit card but there was PPI with both. I am repaying both of these back. Do I still have a case for re-claiming the mis-sold PPI?
I had both with Egg as well! I sent a letter to claim back PPI for my loan first of all, not a problem, got a letter back saying it was missold and I would get a cheque for £720.00 in the post, sure enough a few days later the cheque landed and was happily banked!
The credit card is another matter, I didn't have PPI on the card but did try to reclaim late charges, etc. I calculated approx £350.00 including interest, etc but the most they were willing to offer was £45.81 as they said their charges were fair, etc, etc.
Kept trying and went as far as FOS but still no budging on amount they were willing to offer so I just took it and closed my account.
So all in all, I reckon getting PPI back on your loan will not be a problem but I'm not so sure about the credit card. Give it a whirl anyway, you've nothing to lose and everything to gain!!!0 -
Received a letter from M&S Money today regarding a credit card (formerly a store card). They say the have reviewed my complaint against the requirements at the time of sale and are satisfied PPI was sold in accordance with those requirements and "in normal circumstances" would reject my claim. However due to the JR they say "Until the Court action has been finally determined, however, we are unable to provide a final response.This is because if the judgement is not appealed or if the Court confirms that firms are required to follow the approach set out by the FSA, we would need to re-review your case and might uphold it,
The banks seem hell bent on ignoring the JR and keeping everything on hold - is it worth sending this to FOS or will I gain nothing by this. It is so frustrating and there seems little we can do about it but sit and wait.0 -
hi just a quick question i've just had my case upheld with an adjudicator against hfc they are awaiting a reply from hfc did hfc pay out on adjudicator or did your case have to go to an ombudsman thanxs for any advice
Yes my case has gone to the Ombudsman, but i have not yet had a final decision, please read below
the adjudicator decides if in his oppinion you have been dealt with unfairly or not, but the Ombudsman must make the final decision
The Financial ombudsman first past my complaint to one of there staff an adjudictor, he felt i was delt with unfairly and he informed HFC of such. HFC ignored it, and now just as in your case it is escalated to the Ombudsman ( the boss), HFC will do nothing untill (the boss) gives the final decision and orders HFC to put the matter right.
The Ombudsman is up to his neck at the moment, waiding through 1000s of complaints, you just have to wait untill he gets to your's. I ring occasionally and ask the progress, and they oppologise that it is taking so long. Which i can accept due to his stock pile of complaints.
HFC dont need to do anything untill they get the order, so just sit tight, I am sure you will get the result you want, but it will not be soon. :T

Its possible of course the Banks may appeal against the court ruling, i am not convinced they will, first they have to request the right to appeal, and i dont think they will win that right. they are attempting to dictate to the courts, (bad move) It is though they are saying we have plenty of loot, look how much we pay out on bonuses, they are about to feel the bite up the backside from FOS, the longer they delay the larger the cost.
I first complained to the FSA Regards Miss selling of PPI BY HFC Bank in early Aug 2010, HFC did not even bother to reply. So i went to the Financial Ombudsman and an Adjudicator found for me. My concern was that the ppi was taken out in 1998, and i believed that HFC was not regulated at that time. But to my delight according to the Omudsman they were. Anyway i did not Argue.
my point is dont let the length of time since you first took out the ppi put you off from claiming.
I am still awaiting the final decision of the Ombudsman, but due the backlog i am still waiting after 1 YEAR 8 MONTHS, it's not a sprint it certainly a marathon. hope this is usefull to some

Its very useful thank you. Its given me a nudge to check on a loan I had with HFC which was all paid up more than 6 years ago. How could I forget that one when I was going through my reclaim fest:D
I will give them a call tomorrow and check it out. I just cannot remember whether I had PPI or not. I know I wouldnt have needed it as I am well and truly covered by work.
Whats a few more months of waiting between friends, I have a claim with FOS and is now with the adjudicator zzzzzzzzzzzzzz thats been on going for about 20 months too. Hey ho in for a penny in for a pound. Pounds please

Hi there - newbie here.
I am making a claim against Lloyds for mis-sold PPI.
I was refused a normal current account many years ago but given a business account, as I worked self employed on and off. When I wanted a loan, I was given a business loan. I questioned this as on a couple of the application forms I stated the loan was for home improvements and another was for cosmetic surgery, which are clearly not business related.
I was basically told that how I had to do it if I wanted the loan and that to get the loan I had to have PPI. Not PPI meant no loan.
I have completed and submitted all the paperwork for 4 loans and sent them off in February. I have had the acknowledgement letter and the 8 week holding letter.
I called them yesterday to find out where my claim is.......
I was told that they had started an investigation and the bank had been given 5 days to respond to them with their side of the story and to supply them with the relevant paperwork. Eight weeks later they have heard NOTHING. The lady commented that this looks very bad for the bank when they make a decision about making a payment to me.
She also told me if it had been personal PPI I would have had my money back by now but because it is business PPI they are waiting for the JR and management to decide on if they will make further appeals etc.
Can anyone comment or advise me on this ?? is there anything I can do to push them to make a decision ??
I have completed and sent everything off to the ombudsman, as I assume there is nothing else I can do to speed this up.
I also have another question - can you claim back the PPI on a loan or other product if there was a default ??

Hi I have been in touch with Simms Carmichael today about my PPi Claim. They said that they have no more info for me until they find out whether the banks are going to Appeal against the judgement.
I was a bit miffed actually hoping for some renumeration.
has any one else had any info back yet?
This is a loan I took out with Household bank that had 2 lots of PPi with it.
Hsbc actually own Household bank/Hfc bank I didn't know that.
So I paid extortionate rates for a loan that came from HSBC.
Sorry to go on,but at the time I was really desperate for the money and was told no PPI no loan.

Simms Carmichael have just rung me at work, saying they have found my original douments,but my PPi agreement has no signature on it.
The woman said I will send copys of Docs to HFC and HSBC.
I said to her that was the copy I had in the post I definately had PPi.
She said HSBC are saying I didnt take the PPI out I know I did is this a delaying tactic on the banks part and Simms and carmichael
I am really worried now that i have wasted nearly 11 months trying to get what's owed to me,I feel like crying can some one help.0
