I included this all in my complaint also saying I believe I was made to take something out that was of no benefit to me.

    Then after a few weeks we got a letter from Central Capital saying GE Money had forwarded the complaint to them as they were the broker responsible for arranging the loan with First National and they will be investigating the claim.
    After that they got back to us basically rejecting our claim on the basis stating that there sales person did explain the PPI policy and that we had 30 days in which to cancel it etc and also enclosed a CD of telephone conversations.

    Anyway sorry about long thread but feel as if I’ve hit a brick wall now after listening to CD I believe my husband was young, naive and was struggling with his finances at the time he just agreed to everything but when asked about PPI he stated that if he was off work due to sickness or accident he would still be paid in which the sales person buts in saying "that’s not a problem you can still get paid from your job and still apply to them (PPI Company) for cover as well as it got nothing to do with it, its a separate thing you have and will be more beneficial to you as will have double money coming in." husband reply's "but I didn’t think you could do that." sales person states "yeah no you can, you can still do that."

    Basically is what the sales person said true can you claim PPI if you are off sick or had an accident and still receiving full pay?

    Any reply’s would be extremely grateful thanks for you time.


    i have highlighted the important part.

    this was an advised sales and you have done the correct thing and got a copy of the recording. now you need to use this against them

    you may have given other reasons on your original complaint which they have used the recording to reject.

    however, you need to write to them and ask them to re-consider your complaint and point out the following.

    point out the time where the conversation starts on the recording.

    "on the recording you have kindly sent to me covering the advised sale of the PPI policy your advisor has given miss-leading advice when he/she advised me to take the PPI and it would Pay Double along side my wages if i was off sick, even re-confirming i would get the payout after i queried it"

    "this alone is very bad aadvice by an adviser who should no more about the product he advised me to purchase. Your adviser should have known that the PPI policy would not pay out while i recieved full pay while off work sick, therefor the product was of no use to me.

    then make it clear they have (how ever many weeks, 8 weeks from original complaint) left to respond with a satisfactory response or your complaint will be forwarded to the FOS as you feel they have not properly investigated the sale of the policy.

    As the Sale was in Aug-05 and covered by the rules and processes put in place by the FSA (introduced Jan-05) then this complaint should not be affected by the Judicial Review Application.

    Hi there

    Not heard of them myself, maybe others have, you can always check them out with claims regulation if they are a claims company.

    However, if you have a reclaim due to being mis sold ppi, this is just as easy to have a go yourself, which will cost you nothing, unlike claims companies who do tend to charge, ask for help if required, or check details here.

    I have never dealt with this bank myself but with lloyds, and they awarded me the redress on all the settled accounts, and one was behind at the time and the ppi on that one was awarded towards that, but anything remaining was awarded to me, such as the interest.

    And for the credit card, there was no arrears on that, and that was awarded to me, but maybe also in your case they will not intervene with the other accounts on yours either and deal with them separately.

    Hopefully someone who have dealt with them will know how Barclays work, good luck with this.

    As this would be my second letter asking them to reconsider do they not only have 2 weeks to respond to me?

    they have 8 weeks from the date you sent your original complaint, if this has expired then give them another 2 weeks, then go to the FOS.

    bear in mind that if you do go to the FOS it will take about 12 months, but based on the recording there should be no problem with them finding fault with this aspect of the sale.

    My wife took out PPI on her Capital One Mastercard in about 2001 and paid it to the tune of about £8 per month until she ditched the card about 3 years ago.

    She took the PPI out because, in her words, while the salesperson did not say it was essential, they did imply she would be a fool not to. But it was totally unsuited to her needs, mainly because she was employed full-time when she applied (and has been continuously since) with all attendant sick pay/redundancy benefits and also because she could always reply on friends to help out.

    She did miss one payment on the card in May 2008 but this was kindly wiped by Capital One because the payment date coincided with the birth of our first child.

    Does she have a case to reclaim the PPI? Unfortunately she has very little or no evidence left to substantiate any claim.

    Is it best to send the standard Ombudsman questionnaire to the company first. Or to submit a subject access request in order to obtain some further information to back any claim up with?

    Grateful for any assistance!

    Hi and welcome

    So basically your wife possibly felt pressurised into taking out the loan ppi?

    I would give it a go anyway with her reasons, see what happens.
    The ppi should have been made optional, and if your wife already benefitted from her employer then there would be no need to another, so its up to you, give it a go if you want to.

    All you do is complete the reclaiming questionnaire, this replaced the template letter on this site, send to whoever set the policy up, such as the head office, keep copies of everything in case this needs to be referred back to at some point, and they normally have 8 weeks, but may ask for more time.
