PPI Reclaiming Discussion part 4

Thanks Di,
Problem is though, something doesnt seem right.
The FOS told them to pay me back the PPI plus interest, and then reconstruct the account by re calculating what I paid each month, after the PPI plus interest had been removed.
My balance now is £5,500, as it was last week, so they are clearing this and sending me the difference..........................
My 3 questions are,
1. How can the balance be the same now if they are supposed to have reconstructed the account by re taking off what I paid each month, once the PPI had been removed. It has to be less, doesnt it?
2. They have told me that they dont provide an itemised beakdown of the figures!.
3. They have said that I dont have to sign an acceptance as the one sent by the Ombudsman is my acceptance!!! I told them that this was just to say I agreed with the FOS ruling.
I am trying to stay calm and logical here but something does not seem right.
Hiya bugsy
Yes good point, it should be less once the ppi have been removed.
If I were you I would go back to contact the adjudicator who dealt with this matter, even if the file is closed they are still able to look into this for you, as they have to make sure all is paid like what they requested.
Like one of my hubby's, it was resolved by the FOS, via lloyds (CC PPI), this was actually paid out in about March time, no other acceptance had to be signed, but some of the calcs did not seem right, the adjudicator did deal with it although they closed the file.
So if you can contact them tomorrow and mention this.;)The one and only "Dizzy Di"0 -

Email sent to Natalie Ceeney and Eric Daniels and phoned the FOS earlier. They are getting back to me tomorrow to speak to someone who deals with the calculations.
Still convinced that they have not reconstructed the account because how can you remove PPI plus interest from 23 years, and then re take off my payments, and be left with the same end figure!!
Lloyds also promised me a cheque for the full amount yet have decided to clear my credit card debt and then reduce my limit, so denying me of money that is rightfully mine.
The next stage of the battle is about to commence.................0 -
i am sure i paid ppi on a store card, however, i seem to recall cancelling the ppi payments last year. i have not used it for a while and have no statements to hand to prove it. if i write to the storecard do i ask for a copy of the store card agreement to check this or statement copies? i have had it for quite a few years so there would be many statements. would i still be able to put in a claim even though the ppi was cancelled?

Lloyds!!!
They don't seem to know what they are doing do they?
Hope this is sorted out for you sooner rather than later again, and good thing that you emailed Natalie as well, hopefully she will be able to make sure they get straight on to dealing with this for you. XXXThe one and only "Dizzy Di"0 -

Hi Hannah
I would write to the office of the store card, and request for a copy of the agreement, enclose the £1 postal order or cheque payment, ask them to supply by 12-14 days.
Your still able to make a reclaim on the ppi even if cancelled, because you still paid so much of it into the account.;)
If you want to request more info/data from your account, a SAR may be a good idea, its up to you really, they have 40 calendar days with the payment of £10 cheque or postal order to enclose.

Hi there
Do you mean you have requested a Subject access request (SAR)?
If so they have 40 calendar days to comply and send everything possible they still hold on you.
And when it comes to the reclaiming side of it, complete the FOS questionnaire, as shown on link posted below, further down the page as stage one.
The questionnaire is in replacement of the first template reclaiming letter, complete and send to whoever responsible for setting and selling you the policy, and remember to keep a copy as well in case you need to refer to it at some point.
They have 8 weeks in full to respond, they may write back and ask for more time, this is okay, if they do then they do normally send a timescale date of when you should hear.
Good luck, its also suggested to post by recorded delivery as well, this is your proof of posting.
Please keep us posted, cheers.:)
I have just got a letter in the post from Halifax. and it reads as follows:
"I have completed my investigation into your complaint and I have arranged for our redress team to carry out the relevant calculation to put you back in the position you would have been in had you not taken the insurance on this account. This is done without admission of liability and in full and settlement of your complaint about PPI on your loan... The calculation will be completed and a letter issued within the next five days"
I am right in assuming that I may be getting something back from them? :rotfl:
They have replied far too quickly, I thought that I would be hanging on for weeks.0 -

Brilliant, well done!
Yes they will be refunding you all you have paid in ppi, possibly interest as well.
I would do what Hannah has done, and request for a detailed written breakdown, your entitled to this on request.:);)The one and only "Dizzy Di"0 -
Hi again
Following on from my post a page back, going to go into the bank with my mate to discuss restructuring his loan so it no longer has PPI....
They had said that while investigations are ongoing the branch will arrange a new loan without protection and for the outstanding balance on your existing loan to be repaid. New loan will be on the same basis/interest rates/time frame honoured etc.
Now, I’ve read on here that some people have gone in to restructure their loan only to be told the payments are infact the same each month.. or sometimes even more!!!
The current loan agreement is below, he’s now paid off more than half of the loan as the balance is down from £18680 to £7472.
I would have expected the new loan to say he’ll be paying about £250 back per month instead of the current £311....? does that sound right or am I completely missing something
Just wanted a rough idea of what to expect before we go in there really
Massive thanks for any help
Dave

Hello all
I am trying to reclaim my PPI i paid on a visa account. I have already paid this debt off a few years ago.
I sent the letter requesting all the info as i was not sure how i was sold the insurance. I used the letter on here asking for all the info.
All i have recieved is a covering letter from my bank and 3 years of statements which i already have.
I do not want to have to pay another £10 as i am in debt. However i do think they are stalling and i know i am entitled to the info.
What do you sugest i do next?
Thankyou for any help.
Has anyone else had experience of reclaiming with the yorkshire bank and were you successful?
Thanks again
