di3004...Thank you SO much, your comprehensive reply is VERY much appreciated... :j(I'm a 'bit blonde' tho :doh: so will have to read it a few times to fully digest the contents!). Once again, many thanx for your help - its given me the confidence to soldier on in taking on the 'big wigs' -- (I was questioning/whinging/moaning about those PPI charges for years... pushing up my repayments... Grrr).........

I sent my letter and questionaire off two weeks ago, and last week I got a letter from Halifax asking for £10 for the relevant paperwork. I have sent this off to them and I now awit for their reply.

Do you mean you have requested a Subject access request (SAR)?
If so they have 40 calendar days to comply and send everything possible they still hold on you.

And when it comes to the reclaiming side of it, complete the FOS questionnaire, as shown on link posted below, further down the page as stage one.

The questionnaire is in replacement of the first template reclaiming letter, complete and send to whoever responsible for setting and selling you the policy, and remember to keep a copy as well in case you need to refer to it at some point.
They have 8 weeks in full to respond, they may write back and ask for more time, this is okay, if they do then they do normally send a timescale date of when you should hear.
Good luck, its also suggested to post by recorded delivery as well, this is your proof of posting.

Hi Everyone
Just thought I would let you know of a recent success against the Bank of Scotland
In 2001, we enquired about a loan.
I absolutely remember the lady telling me that beacause of the ammount,if we didnt take PPI,we wouldnt be looked upon favourably.
So we took out the PPi but after a year I thought ,no,lets cancel this and I was asked into the bank and a very,very nice lady said to me that this should never have been said to me,the PPI was cancelled and the loan payments reduced drastically.
The loan was paid off in 2007 but I never forgot how I was " seduced" into taking the ppi.
We bank with the Bank of Scotland so didnt want to S--t in our own nest but recently thought,no, they were not fair with us.
I sent a very nice letter to them explaining what had happened and that I had cancelled it after a year and what were their thoughts.
A week later a lady phoned me to say she had looked into the situation and I had not taken PPI in the first place against the loan.
This got me somewhat " agitated" to say the least so I said no probs,will contact the FSA.
The lady then completely changed her tune and said she would further investigate and call me the next day.
Well,what a surprise,the next day she phoned and said,yes,found it and I am upholding your complaint !!!
How convenient
Received clarification on Friday,that £4300 will be put into my account within 5 days.
You know,what gets me is that we put our trust and faith in the banks and they blatantly lie to us,they should hold their bloody heads in shame,how dare they try to shaft me.
Morale of the story

Aftr a fight lasting nearly 3 years I finally got my credit card PPI settlement figure from Lloyds today.

Problem is though, something doesnt seem right.
The FOS told them to pay me back the PPI plus interest, and then reconstruct the account by re calculating what I paid each month, after the PPI plus interest had been removed.
My balance now is £5,500, as it was last week, so they are clearing this and sending me the difference..........................
My 3 questions are,
1. How can the balance be the same now if they are supposed to have reconstructed the account by re taking off what I paid each month, once the PPI had been removed. It has to be less, doesnt it?
2. They have told me that they dont provide an itemised beakdown of the figures!.
3. They have said that I dont have to sign an acceptance as the one sent by the Ombudsman is my acceptance!!! I told them that this was just to say I agreed with the FOS ruling.
I am trying to stay calm and logical here but something does not seem right.0
