Your hubby may be right with what he says, dont know how you would find this out though.Maybe look at the contract you signed with these and see what it says. In my opinion option 3 is the best as you will save thousands of pounds interest as the ppi would still be on your loan for the remaining term, and you save £100 a month the only prob with that is you will have to find the cash to pay the claim co. Option 1 sounds ok if the claims co have no claim on the overpayments. option 2 would benefit the claims co, only you can make the decision. Good luck xx

Hi Guys.
Hope someone can advise me of the next step. I recently wrote to all my loan companies for a copy of my agreement, unfortunately, I destroyed all my paperwork when the loan was settled. As I do not have the agreement number, I gave as much details to the companies for them to search on their system. This included:
my full name
address
date of birth
mobile
start date of loan and settled date (Feb 2006 - May 2006)
term and amount (these were taking from credit file)
I have checked old statements and unfortunately payments taken out by Direct Line did not include a ref number.
Direct Line has replied with a standard letter:
" We have conducted a search of our records using the name and address supplied. From the information you have provided, it is not possible to trace the accounts you requested,
Please contact your client to ask them to clarify their details. Where possible supply full name, address and agreement number quoted on the customer's copy of any documents provided to them from the lender"
First of all what client?!... I am not a company and I am the direct customer...second of all, I explained I do not have any paperwork in my letter already and have given them all the details I could think of giving them.
Since the loan was taken out in 2006, it has only be four a bit years, so they should still have my records. What happens if they do not and they have misplaced my details?

What about a credit report?
Sometimes these are free for 30 days, or google in Equifax, or Experian, and I think they send you this information all for £2.
So anything you have taken out over the last 6 years should be enclosed.;)The one and only "Dizzy Di"0 -

thanks....i did get my credit file and it doesnt have the full ref...like the last 4 digits. I would like to find out if the loan company would get into trouble for not being able to find my details?...0 -

I would contact the Information Commissioners office (ICO) for advice and see what they have to say, I believe they should comply by the DPA (Data protection act) and send you your details, you have the right to these.

I would give them a quick ring, and ask if they are dealing with your complaint.
Or write to them give them say a further 14 days max and tell them if you hear nothing you will continue to complain to the FOS.
Tell them you have proof of delivery.:)
That is so annoying, they could have at least wrote back to even let you know or confirm they had received your complaints and currently dealing with them.

Thanks for your advice. Rang hsbc earlier today, and they claim to not have received any of the 3x claim forms and are concerned that I have not raised a complaint with them. I said I thought the questionnaires themselves would show I was unhappy with hsbc service! I also stated I had proof of postage and that I'm more concerned that they've lost personal info of mine now! They suggested I resend it to them, I said no I'd only do it electonically now as they'd lose them again. So they've given me an email address to send through my copies I sent originally. Far from happy with this mess!
Do I now still have to wait 8 weeks again?

So sorry to hear this, and how incompetant of the muppets!
What I would do (if you have a printer) print off the proof of when they supposedly had received them and ask tell them you would appreciate it if the 8 weeks could be as from that date shown on the proof of receipt, give it a go, its not your fault they lost your complaints.;)

Sorry if this has been covered before but I am new to this. I wrote to GE asking for refund of PPI on a 5 year loan i took out in 2000 but they rejected it due to it being over 6 years old, however i have noticed a number of posters saying they have been refunded PPI from the 90's. I have the original agreement. can i go back to them? and if so on what grounds?
