Your very welcome
Don't know who set up and sold you the loans, but its whoever did is the ones you pursue, just thought I would mention this.;)
Look forward to hearing the outcome, fingers crossed.:)The one and only "Dizzy Di"0 -

I now have my response from MBNA with a load of paper work that I dont understand, but primarily a copy of my application form with a tick in the PPI section. This was a papar based app so I obviously ticked this myself.
How does this leave me with my PPI claim? Isnt this evidence that I said I wanted it?:(

Hi there
Was this info sent to you on requesting by a Subject Access Request (SAR)?
Basically the information is useful to have, such as dates the loan was taken out, the agreement is also good to have, as this shows the ppi added to the loan, and the amount and so on.
There are so many reasons for mis selling, but having the info on hand is useful, for example if you tried reclaiming the PPI and they did not uphold in your favour, or give you an offer, then you have the details to send on to the Financial ombudsman service (FOS), they would possibly require copies of these so they have something to work by.
On the link below, check out the checklist of mis selling reasons, and if any of them apply to you then you have a reclaim.
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance
What you do is instead of sending a letter the (FOS) have recently issued questionnaires, complete and use these to reclaim and send to whom mis sold you the policy, for instance whoever sold and set up the policy from the start, keep copies as well, they have 8 weeks in full to respond.
Also on the above link is where you will come across the FOS questionnaire - further down the page as stage one of reclaiming.
Follow the procedures as shown on the link.
Also get proof for posting from your local post office.
Hope this helps, good luck.;)The one and only "Dizzy Di"0 -
Thanks for the reply
Yes I sent the SAR letter with £10.
I am not sure if I should proceed as I have 2 other cards with MBNA and since I wrote to them they have decreased my limits on all 3 cards (twice for one of the cards and once for the other 2)
I am worried if I proceed that will just ask me to pay ALL the money I owe them which I cannot do.0 -

Hi
And your welcome.
They should not discriminate you for reclaiming what is rightfully yours, they must treat you fairly as a customer.
Its up to you of course, and also wait for other opinions if you want to, but they cannot at all make you repay all the money you owe either.;)The one and only "Dizzy Di"0 -
Sorry to be a pain, but if i ticked the insurance box myself on a paper application, am I not responsible for agreeing to this product is I had no previous medical conditions, was not self employed etc?
I dont really understand on what basis I can try and reclaim? Any suggestions0 -

Hi there
Your not a pain lol.:D;)
We all have to sign the agreement to be allowed the loan etc, but some have been pressurised into taking out the ppi, as said in my above post there are many reasons for being mis sold the PPI.
And depending if any of them apply to you - you basically take if from there really. The one and only "Dizzy Di"0 -
I used to think that PPI was all part of the loan/credit card etc, as I was never told different, so all signed for.
Yet when these were sold to me, I was a home-maker and only then receiving my children's benefits, so in this case I would not be eligible to make a successful claim.
And of course I also used to think if I cancelled the loan, then I would have to repay all back.;)
Its only since all this have come about in the media that we have realised that we were mis sold. The one and only "Dizzy Di"0
