how to handle counterfit items??

Hi everyone..
hope that you are all enjoying the snow!!
i would like some advice on how to handle a situation..
i have been having a bit of a clearout selling a few bits and bit the bullet and bought an item..
it was a gift box of expensive toiletries (Molton Brown - cost me £50), but unfortunatley.. the item was described as new and when i recieved it it was not, all dirty and scuffed and soiled gift box.. not badly but enough to think that it was not as described.
well, to top things off i have since discovered the items to be counterfeit as i thought they did not smell right and took them to a store, the bottles are not but the the creams or gels that should be in there are most definitely NOT molton brown.:eek: why would someone do that??:mad:
i have asked for a refund but the seller maintains it was new, have told them that it was counterfiet, and have not got anything back and indicated I will escalate via paypal.. but not sure what else to do?
can someone please advise..

It is bad though, sorry.
I'm guessing you'll have to open a paypal dispute, and see what they tell you to do- the seller probably wont just give you the money back unfortunately lolThis is my opinion. If you can get written proof from the retailer that you took your item to stating that it is fake then Paypal won't ask you to return the items to the seller and a refund should be granted.The shinbone is a device for finding furniture in a dark room.:TBig thanks to all competition posters:T0

i should not return the items? the seller has asked me to return them now?
will i get stuck with her claiming i sent her a counterfeit back!?

Don't return them because then you haven't got the proof...start a Paypal claim for item not as described, state that they are fake as confirmed by X from Molton Brown [try and get something in writing] also state that the box was not new, scuffed, looked used etc thus not as described in that sense either. No point returning as if she's not being accomodating so far I doubt she will be once returned...have you seen what else she sells? Was this a one off Molton Brown sale?
Also...my understanding is that you don't need to send fake goods back - illegal to put them in the post? Something like that...Baby Boy arrived March 25th 2010 - 17 days late & 8lb 10oz :j0 -
Tell them you won't be returning them and you're entitled to a refund.
If they refuse, open a dispute.
You have proof, right?My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

you are right.. it might leave me in trouble if i send back.. i dont have it in writing from the shop , as the assistants compared it for me very nicely and said no it is not molton brown!.. i dont know how i would go about getting a letter from them ... would they be accomodating? i geuss i will have to contact paypal and see what they say
this is my first experience of this.. dare say i will stick to the shops..
and yes it is a one off item from the seller, said she got as a gift.. and she has been a member since Dec 07 and about 30 positive feedback..
all over the year and a couple recent good ones..0 -

I have had to get a shop to write a letter as proof before and they were only too happy to do it. Think the manager was as angry as me that someone was selling fakes to be honest so they didn't mind writing the letter at all. Even if its only a short note with a contact number for them on anything is better than nothing.
