well, i have opened a dispute but do i escalate to a claim to get my money back or will paypal not look at it since the seller has already agreed to:rolleyes: refund my money?
funny thing is the seller already gave me a positive feedback the day after before i even got it!?:rolleyes:0 -

i havent got anything back from paypal by email as yet but the seller is asking if i have posted the items..
do i let her know that i am consulting paypal? and can not post until i recieve a response?
or do i escalate my dispute to a claim..?

Don't waste time waiting for a response, you have to ring them and hassle them for one in these cases.... good time to get your proof sorted out if you haven't yet.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
hi i seem to be having the same problem but over timberland boots.
i have opened a dispute this morning with paypal for fake counterfit goods.and have emailed the seller who said he wants them back then he will refund,
they were sold as used but only once, when they came they were in a timberland box but for a differnt type of boot, they reek of glue or plastic or something like solvent, only when you compare them to my other pairs you can tell they are fake. the timberland logo is slightly diffrent, and the soles are diffrent also just slightly, and eyelet holes too.
they clearly have never been worn there is not a mark or crease on them. they are imacculate (new).
the buyer said in his reply they were a gift to him and he does not believe the person who give them to him would give him fakes.
i told him i would not be returning them as it is against the law to ship conterfit goods???? am i right to do this?
he asked me where i got my facts from on this issue?

sorry to hear you appear to be having the same trouble,
i have already raised a dispute and my buyer has agreed to refund.. but i am stuck in between escalating to a claim, or sending it back to the seller and risking not getting a refund or even being accused of returning fakes..
it is a double edged sword.. i have not had much joy from paypal.. apart from that if i send it back it must be via trackable method, and they said i can raise it to a claim and leave it to paypal for a decision..but not sure yet..
hope that your buyer co-operates and you get more joy, take it to a shop and get it confirmed like i did, but i still have to get it in writing..

hi ive just checked my ebay account and they have cancelled the listing for the boots... its a bit late
even if i take the boots to schue or some where that sells them and they say yes they are fakes , then how do i get them to write it down to make it official.
what do you do then with the paper.
my oh said he would just keep the boots , but ive told him to wait as there fakes and like you bought as thought they were the real deal.
ebay doesnt tell you what your ment to do. do you return for the person to relist and do the same to someone else.?
or do i keep and complain.
unlike you the boots are wearable and oh said he will wear them , but thats not the point...
aggghhh its so frustrating.

To anyone having these problems with counterfeits....
Make sure you file a complaint "Item not as described" and in most cases ebay with Paypal will refund your money. Make sure you do that asap. I don't think it is that important to obtain proof that the items are counterfeit. I had two cases were I got a fake SC card and a fake Bugatti jacket and in both cases appealed and got my money back. The way I found out was by calling Sandisk and giving them the serial number and as for the Bugatti jacket I owned a couple of them previously to know the difference.
As for the sellers wanting back their items, only agree to send them back if they cover your postage. If not, say that you are not going to lose money over something that is clearly their fault. In my case both sellers did not agree to that and told me to keep the items. Stick on your ground and hopefully you will get a full refund.

We had the same problem with fake Nike trainers a while back. I opened a dispute, called ebay and was told I needed proof they were fake. After much calling around ( I found shops were not happy to be involved as they were concerend about legal involvement) I contacted Nike HQ. I posted the trainers to them, they confirmed they were fake and contacted paypal who gave me a full refund. Nike kept the trainers. The most important thing is to get the proof. From my experiance I would say always go straight to HQ as they will have a team that work on Brand Protection.0

how to stop these sellers is the main issue rather than individuals get a full refund for counterfit items, should ebay link this the the police or terminate all the seller's under the same register name and address:beer:0
